Default Dealing with a incooperative seller....

I was wanting to get some feed back on this...
If you ordered something from someone and they sent you something that you didnt order, nor did it come with everything they said it would, what would you do in this case?
When you called them on it and they said to send it back, and you did, but they didnt refund your money, or call you back when you left messages, what would you do?

I am just trying to figure out what I need to do in the situation.

Who, what, when, why, how?
All the above is kinda need to know information. Was it a privat party a shop? Basically give us the lowdown and then we can give some suggestions on the best way to resolve the issue.

Sorry to be vague. Basically what happen without giving names:
Purchased item for a honda from a persons business
Item that was sent is not what was ordered
not all parts were there
called them back, agreed to send the item back
sent item back
over 35 days later account had still not been credited
called the guy out, gave tracking numbers dates etc, he still thinks he did no wrong


that is a basic run down of events

they sent me a fiberglass body kit for 399 and a free cf hood.
the bodykit is missing the rear.. (they say its on back order, i dont think ill ever see it). the hood is for a 99-00 civic, i own a 97. and fiberglass(chipped and cracked from shipping) is a pain in the *** to be bondo'ed.
i may have to disputed it with my credit company

if that dont work and you have his address break his kneecaps with a sledgehammer damn scammers, whats sad is scum have the odacity to stick up for ppl like this

j/k it's an intelligence test. Mensa is a club for genius'. you have to take a test to get in and the questions are very vague and hard to answer.

A lot of these guys are right. More information is needed.

Did you make the purchase via an online escrow service? Paypal?
Did you pay for the item(s) with a USPS money order?
Did you pay for the item(s) with your credit card?

If you paid with a USPS money order and still have yet to receive the product then that is considered mail fraud and the USPS will be more than willing to jump in and help you handle the situation. After notifying the postal office, call up the Sherriff who has jurisdiction over the county that the business or person lives in. Notify them.

If you paid with your credit card then you have options. Best thing to do is to call your bank and notify them. Then, call up your credit card company. Your credit card company and the issuing bank will jump in and seize the funds from the seller. You'll get your money back. Credit card companies are ruthless and I have yet to hear of a situation where the "victim" (if you will) was not reimbursed in full.

As far as Paypal or other online escrow services go, I'm sure that they have policies that can and will help you out.

There are legal ways to get your money back. Don't threaten the seller and becareful of what you say. Best thing to do is to let your credit card company/bank or the proper authorities handle it. Turn up the heat on them and they'll wish that they never messed with you.

Also, you could contact the better business bureau just to check out their track record and file an investigation. However, it already sounds like they have a ****-poor track record.

If you used a postal money order or your credit card, it doesn't have to be a business, it could be an average person like you or me. They can't run. Turn up the heat and fry them.

only mail fraud if it went through the usps mail system..... doesnt matter if you paid with a usps money order ... only if it was mailed through them .....
