a cop has the right to search your car, he can bullshit and say he has resson to search and he is allowed to search even without your consent because its a moving vehicle and not a house so therefore he does not need a warrant.

no he doesnt have the right to search yur car if u invoke yur rights. and if u say that and he does anyways then anything they find cant be used against u because it was an unlawful search. i was pulled over one time after only having a beer at a friends house (i was 17) but nowhere even close to tipsy. he mustve smelled it and asked if he could search my car and i said the speedlawyers.net thing. then he asked if i would submit to a breathalizer. (and of course if u refuse one u automatically get yur license revoked right?) i used another speedlawyers.net thing and said "i am not refusing to submit to a breathalizer. i will submit to any breathalizer or field sobriety test in the presence of an attorney" the cop said that he would arrest me for not cooperating and i said ok. then he just called my parents and said i wasnt cooperating and he smelled alcohol. and my dad ended up coming and driving my car home. he gave the cop hella **** about harrassment tho. kewl dad alot of people dont know the full extent of their rights and how much police exploit our ignorance. like they may search yur car and find something and charge u with it even if u did all this stuff. but then u and yur lawyer go to court and get all yur **** dropped cuz the cop broke the rules.

o and so u dont think im just some punk highschool kid that thinks he's kewl. im nto in highschool anymore im almost 20 (and i kno thats not much older haha) im just informed in this area. i dont mean to be argumentative or anything im just talkin

 

Update on my legal situation...


All charges dropped


I paid court costs ($130) and walked out a free man. It helps when the D.A. is hot and 26-27 years old... and doesnt mind a little flirting.

dude, don't worry about a warrant guys, it's all about PROBABLE CAUSE. end of story! if the cop has reason to believe you have something in your car that you shouldn't have, he'll ASK if you if it's okay to search your car, ONCE you say yes, you give up your rights and he has the right to search YOUR car. trust me, been thru this more times than you can count on your fingers...

yea not around here... then they will pull the "since you said no, i now have a reasonable cause that you are hiding something"... my friend tried it and thats what happened to him along with the k-9 unit they called in on him

 

damn dude. i kno ive been really lucky. but seriously when they pull that **** u can use that against them in court. i have a friend who had some weed in his car and got busted like that after he said they couldtn search his car. and he said harrassment and ended up getting off. he had an attorney tho

 

haha i was in a canyon one time and your not supposed to make a turn in the middle of the road but i did it anyways. i couldnt make the whole turn completely so i reversed it and took off, when i notice a cop pops out of nowere and puts his red and blues im like expletive i turn my head to look back after i stopped and he has his gun out im like wtf haha he was alright he didnt give me a ticket and didnt search me even though i told him he could when he asked me, he gave me a warning and let me go and down i went through the canyon.

 

I have to say this in most legal based posts, but I'm not sure if it's the same in America as it is in Canada - but - they can search you with probable cause.. If a cop sees a bunch of smoke coming out of the windows when you come to a stop, notices some weed on the dash, and you smell like a grow op - he can search you for dope. He can, however, not bust you if he finds a gun in your trunk and it's illegal - as he wasn't searching for it.

Same thing goes for having a few kilo's of coke in your car, and leaving a job site - speeding - they pull you over and wanna search for stolen tools cus there have been reports... They find the coke .. You're free to go, minus the drugs. No charges though..

That is, unless you say "Yeah sure, search away"

I've always said it's fine to search my car, and they rarely ever do - "Would you be alright if I searched your car?" Sure officer, I have my xbox in the trunk, my camera gear in the backseat, and a case of beer beside my xbox - the rest is all clean.. Want me to pop the trunk?" No problems..

... glad they didn't pop the trunk and see the midgets.. though.. That would have been awkward.

 

lol thats funny. i dunno i find it hard to be friendly to cops. my dad has alot of cop friends and for the most part they r ******** on power trips. with a few exceptions.

 

Lol i remember when i was visitin my family in la in my first car it was a 4dr da ^_^ it was like 2:00am when i got there and i was driving around to find something to eat then all of a sudden i get pulled over for no reason they search my car and found nothing cause i had nothing but clothes, 5 mins. later i get pulled over agian by a different cop askin what am i doing driving around i told him i was lookin for something to eat and point me to a few open late night resturant then let me go i say about another 7 mins later i get pulled over agian by another cop asking the same question he let me go, tahts when i got tired of getting pulled over and just went home, i was about 5 blocks away from my uncle house and i get pulled over agian same ****, this time i told the officer i got pulled over 3 times alrdy can u give me a break and he let me go laughin, right when i bend the corner to my uncle's house i get pulled over agian and same **** this time he checked my car. im so fed up with the expletivein cops pulling me over just cause i drive a lowered car . Next time i go back to la to visit im renting a SUV

same thing happen to me not as bad tho my radiator support was that badly bent but my hood and bumper get expletiveed and my headlights were completly smashed but i got a new hood bumper and headlights i should be getting my radiator support fixed this week

haha one day i was getting out of work and i was just sitting in my car warming it up when out of nowere the pigs roll up on me i seen them go in the lot but i didnt pay attention to them until they stopped me with their lights like what expletive. the first thing they did was look at me and pull the gun out on me like damn again, at that time i got mad like wtf pulling me over for doing nothing then the 2nd cop looks at my car and notices i have no front plate then i gave him attitude and he got mad and slammed my door he was trying to bust me for something but could'nt cus i was legit,car registered licensed and insured he just gave a fix it ticket for not having a plate in the front of the car .i guess i helped him reach his ticket requirements for the month.pigs

yeah i already got it fixed, i got another hood, bumper, headlights, radiator, and hoodlatch. Got the radiator support straightened out and parts put on for 450$ only problem is the hood is primered and the bumper is black, so im going to primer them both out the same color and save up to repaint, i'll post pics soon
