Actually Honda has had a few cases where the transmission was messed up from the beggining. Tell him to bring the car to the dealer and more than likly he will get a overhual of the tranny done.
i already know its under warranty i just want to know what the problem is or what it could be...you know for future reference and what not

It sounds like the synchros are bad. This is similar to what my friend is going through except he has an '01 Civic LX coupe. He can't go into 1st gear or reverse and his mechanic told him that it's due to having bad synchros in those gears.
I don't know much about the EP3 tranny and it's reliability. I have an '03 EP3 and it doesn't always shift correctly like it should. Occasionaly, it grinds into 3rd and sometimes its a pain to get into reverse. It's not consistent though so I think the synchros are fine.
I recommend that your buddy takes his EP3 to the dealer and has the tranny looked at. This shouldn't be happening on such a new car and hopefully Honda will pick up the tab to fix it. Good luck.

As you mentioned, sounds like a synchro issue. Bring it to Honda. Try replacing the tranny fluid. I've heard great things about GM Synchromesh friction modified tranny fluid. I think it's wortha shot..
