Yep.. I got into an accident with a guardrail and myself. Messed up my front bumper, hoods shifted to the right, left headlight gone... but that donesn't concern me right now. I need help fighting this ticket and i need some opinions on what you guys would say when you go to court. This would be my 3rd ticket and i'm lookin at a 3 month suspension of my license.. It was a downhill turn. I was going 25 mph, and the speed limit was 45 mph. It was snowing and I hit a patch of black ice on my left side of the car. The car basically lost control and i hit a guard rail. No one was involved or injured.

You were going 20 mph under the speed limit, and got in an accident all by yourself, and the police gave you a ticket? What the hell?

I agree that downhill turn, snowing, you should be going slow... but it sounds like you were! 25 mph is like a snail's pace for me. Giving tickets to people just for the hell of causing them trouble is messed up.

was he there when you lost controll? is there such a violation? if he wasnt there then he has no rite to give you a ticket.. becuz he didnt witness anything.. so he cant give you a ticket from guessing....just go to court and tell it how it really was..i think that was a "QUOTA'' ticket! meaning that how he gets paid...more tickets shows that hes doing his job as they say.. just say to the judge the police officer wasnt there to witness anything..

seriously, if you were goin 25 in a 45 that is well under posted limits, and it is impossible for the officer to determine what is "safe under the conditions" when its snowy, i mean its not like you left any skidmarks that he could even determine what speed u were goin in the turn anyway.

When you go to court take some pictures of the accident scene, and explain that the roads were not cleared up properly. Also it would help if you said that there weren't any signs that say "watch for ice" and the officer can't prove your speed, so ask him to do that.

My friend got a ticket for going 5 MPH on the freeway... it was a speeding ticket... LOL. He wasn't paying attention and bumped the car in front of him... a cop happened to be in the same traffic and wrote him a ticket.

cops are a bunch of dicks..i would fight that ticket man...like they said..take pics and all...and the cop wasnt there to witness the accident so he cant say ****...just what i think...i will check with a friend of mine that is a cop..and see what he says and get back to u..

Go to court and tell the truth. Your case is pretty solid...accidents happen in foul weather and in this situation, this was obviously out of your control.

One thing that may make you lose is if you have tires that are not M+S (mud & snow) rated. Where I live, cops can get you for that if driving under snowy conditions. Otherwise, you have a great chance of winning the case: snow, a downhill turn, black ice, you were going slow, and no witnesses.

Yeah I took pictures of the scene, but there wasn't any heavy damage to the guard rail. It doesn't even look like that it was hit... I'm just hoping that the ticket would be dropped and that it will just be void and nullified. Thanks everyone who replied.

I once got a combo ticket:

1. Too fast for conditions
2. Unsafe lane change
3. 85mph in a 50mph

The cop that pulled me over was an undercover "road rage" cop. I was getting on the freeway, and just accelererated from the right lane into the fast lane (I used my blinker) and he was just sitting back waiting for me because he knew I was going to do something.
Anyways, I went to court and the judge just laughed and dismissed it entirely. I guess it was just my luck day . Just tell them the truth, and hopefully the judge will be cool, you didn't do anything wrong or hurt anybody.
