hondata s300 q29 transistor has 12v goin to heat sinc

i have an issue with the ecu seeing pressure from the map after cranking. i have no datalog as the car wont start this way, but cranking the map is going positive, the boost solenoid goes crazy, thinking it is seeing boost it needs to control. all pins have been gone over like 15 times to make sure they are right.
this problem has been intermittent untill now it is all the time.
the heat sinc at q29 has 12 volts at it when this problem is occuring. before when the issue was intermittent, when it wasnt posing itself, there was no voltage at the heat sinc. now that it is there all the time there is 12v at the sinc.
is the transistor shorted out?
when i installed the map, it may have had a bad joint that was shorting, but i have since been through all that and cant say that that is the issue.
