Default Q regarding putting on older model year engine in a newer car

Let's say I've got a 96 Civic Hatch...I want to put a 92-95 JDM GSR motor in it

I have always read that you need to swap in a newer or same model year motor in order for the car to be emissions legal...Why is this ? Does it simply have to do with OBD1/2 or will inspection *somehow* catch you with an older motor and not pass you ?
