On the topic of who would be at fault, it would be the rider for making an unsafe stop. Just because the SUV hit him does not mean the driver was to blame. As a former insurance claims adjuster I can say with 100% certainty that unless he was stopping for a cop in the middle of the road he would be to blame. If you brake check someone and they rearend you, you are found to blame, same goes with doing a stoppie.
And I read on another forum that the SUV driver was actually the riders girlfriend and she didnt leave, she went further up the road to turn around and came back, but they had cut the clip so it left everyone believing she ran.

If you just tap your brakes then you'd be fine, but if you actually full on slam your brakes then yeah it would be your fault for an unsafe stop.

i think your wrong, because you could just tell the cop a car/dog/mouse/deer/dingbat ran out in front you
99.9999% of the time in rear end collisions its the person who hits the other persons fault because you need to allow ample stopping distance from the person in front of you.

I work in claims, I can tell you that its about 50/50 when it comes to rear end collisions.
In fact I was involved in one last year, I hit a woman from behind, but because of her darting over 3 lanes and pretty much stopping dead in my tracks causing me to hit her, I was found NOT at fault.
Do you still want to have this arguement ?? If so PM me and we'll talk, otherwise I'm done with this arguement.
