I had that happen to me once before, I didn't torque pressure plate bolts down correctly and one punched a hole in the case of my tranny, has nothing to do with hmotors, probably who ever owned the motor/tranny before hmotors got a hold of it replaced the clutch and didn't torque bolts properly

You really think hmotors would go through all that ? If it was an automatic, they would of pulled the trans and tossed a manual one on the pallet.

i believe what john here is sayin is true well this is the thing on places where you buy JDM motors cause this has happened to my friends car while i was driving it see the thing is he bought a complete jdm gsr with tranny the thing was so wel installed it yada yada and while i was driving it the pressure plate and clutch came off luckily i wasnt going fast see the thing was his motor was a automatic motor and whoever switched the auto tranny with a manual tranny didnt change the pressure plate bolts cause manual pressure plate bolts are a little longer and well your tranny got pretty f*cked up but yeh im pretty sure that this is what happened

I just tell them what you told us, and if they ask you why you didnt pull the trans off, explain to them you bought a complete eninge and tranny, and that you expected that if it came from a working car it should be working properly when you recive it. Just tell them it calmly and dont start yelling or getting upset. If they get defensive, right away then act like a dick.
Thats pretty much all i can tell you, if they are as good as they used to be they should replace it for you. In all honestly i really dont think its your fault. and i think they will understand that you had a budget.
Good luck

Re: (MENACE)
If I was to buy an engine/transmission from an importer, I'd do a partial disassembly to verify the condition and replace "wear" items. If you did this, you would have found that the clutch pressure plate wasn't bolted down tight.
However, for discussion;
If the transmission was attached to the engine when you got it, then I feel you may have an valid point to discuss. Your assumption is that you are buying an engine/transmission that was running and in reasonable condition when pulled from the original car.
At what point is it your responsability to disassemble it looking for problems? As an example, would it be your responsability to pull the oil pan and check that all the rod bolts are tight? How about head bolts?
If they say that it's "standard practice" to replace the clutch, ask them why the old one was provided if not needed. I'm assuming that it would be easier to ship the engine and transmission as separate items.
