hmmm....this sounds similar to a problem that I had on my Type R and my friend had/has on his EK.

On my R, it turned out that the Speedo sensor was shooting a code, but didn't know it until I had the car smogged. I changed the sensor out, and fixed it temporarily, but the problem kept coming back. Never had it fixed. I just got a OBD1 chipped P72 ecu so VTEC would still work. I didn't care about the speedo working at the time. I was told by someone that the wiring somewhere leading up to the sensor was bad and would cause a good sensor to pretty much go bad as soon as it was installed. Sounds crazy, but I never looked into it any further

My friend's EK has a JDM B18C SiR-G swap and I noticed that it has done this for the last month now. The speedo will occasionally twitch around and may stagger a bit when engaging in VTEC. He never gets a check engine light because his only happens for a moment. I noticed with my car that it got progressively worse. I'd like to know how many other people have this problem. I'd like to find a way to fix it. It's really annoying. I'm sure it is for you, too.

vtec still engages but now it is happening in the lower rpm's also. it's almost like its gonna puke out but then it keeps putting along. could this be a fuel problem?
