you hear the "whistle" probably because the pipe is closer.. i bet if u put your ear near a cold air which would be by your front bumper it would be the same diff

Yes, it's very noticeable in a short ram intake and not so noticeable in a CAI.
Go for the short ram, it gives you slightly better throttle response, a hell of a lot cheaper, and it sounds nice. It also equals out the front and the back pressure, so your entire car will sound diff.
Like if you put JUST a short ram intake on the car's RIDICULOUSLY loud inside the cabin, you won't be able to hear the person next to you at redline. Though when you put an exhaust on it the pressure is more equal so it's not as obnoxiously loud.
Same goes for just an exhaust vs an exhaust + intake.
One of those eBay ones are fine with a real filter - a pipe is a pipe, that's the one thing where it's "okay" to buy eBay parts . Then just throw a K&N on the end or something, AEM, whatever.
Go for the short ram, the CAI will net you more power but when ur talking in terms of a stock EX the power difference will be null. Pay the 40 bucks for a short ram setup (real filter + piping) opposed to 300 bucks for a AEM V2 CAI or something to the effect.
Hope that helps .
