Default SMOG HELP!!!!!!!!

ok...to make it short...i got pulled over for "street racing"...the cop thought i was part of a bust that occured right around the corner...wrong place at the wrong time...anyway...after realizing i was never in that area before and was following a friend to another friends house which was literally 200ft. from where we got pulled over, we still both got ticketed...the cops popped our hoods...his, GS-R with bolt ons it no prob for his modified emissions tickets cause it can go back to stock...mine on the other hand, JDM ITR with bolt ons...thats a problem...now, we didn't get fined for being a part of the racing in the area but we were fined for the emissions...MY QUESTION...how much is a modified emissions ticket, my motor CAN NOT goto the ref...no vins...no its not stolen I bought the whole car that way...a few ideas of mine are to say i sold the car as an off road use only vehicle...say the motor blew up and is in no working condition...my main question is HOW MUCH IS THE FINE????? thanks so much for the help...

when I went to the ref he didn't check vins...

Oh yea I heard the modified emmissions tickets are expensive. Don't take my word for that though. Free bump.

First off if I was in your position I would NEVER let the cop pop the hood and would argue the real reason I was there. Second I would ask the cop for any proof he had that you were involved in street racing what so ever and not driving like you were. Finally why not just pull your motor out go back stock take to ref and put your motor back in. That's what most people do with their civics with swaps. Not that hard and easy to do if you have all the right tools/equipment.
...and in california...I'm sure the fines will be rediculous for emmissions (don't spell check me) problems.

well lets see...i don't have the stock motor...the ability to gain one...the time, tools, or skill to perform the swap...if the fine was under a grand then i would rather pay it than peform the swap...anyone have an idea of how much the fine is exactly?

I hear you...but ask around locally maybe somebody could help you out or do it cheap (labor). Plus buy a stock swap (dirt cheap). You could easily get this done for under a grand plus then you'll always have the stock swap for next time...gotta realize this might not be the only time this can happen. Well...good luck though anyways.

were you caught "racing" in irvine? Does your car have a stock exhaust or not? And do you have the vehicle code for this ticket?

i was pulled over in Anaheim as my friend and i both drove past a bust that was on the side of the road...one of the cops pulled out from the side and pulled us over as we proceeded across the street...my car does not have a stock exhaust...custom ES oval exhaust...*looks stock*...the vehicle code is 27156(B) V.C.

don't know if this will help but here some specific detail about the law.

shall disconnect, modify, or alter any such required device.
(c) No person shall install, sell, offer for sale, or advertise
any device, apparatus, or mechanism intended for use with, or as a
part of, any required motor vehicle pollution control device or
system which alters or modifies the original design or performance of
any such motor vehicle pollution control device or system.
(d) If the court finds that a person has willfully violated this
section, the court shall impose the maximum fine that may be imposed
in the case, and no part of the fine may be suspended.
(e) "Willfully," as used in this section, has the same meaning as
the meaning of that word prescribed in Section 7 of the Penal Code.
(f) No person shall operate a vehicle after notice by a traffic
officer that the vehicle is not equipped with the required certified
motor vehicle pollution control device correctly installed in
operating condition, except as may be necessary to return the vehicle
to the residence or place of business of the owner or driver or to a
garage, until the vehicle has been properly equipped with such a
device.
(g) The notice to appear issued or complaint filed for a violation
of this section shall require that the person to whom the notice to
appear is issued or against whom the complaint is filed produce proof
of correction pursuant to Section 40150 or proof of exemption
pursuant to Section 4000.1 or 4000.2.
(h) This section shall not apply to an alteration, modification,
or modifying device, apparatus, or mechanism found by resolution of
the State Air Resources Board to do either of the following:
(1) Not to reduce the effectiveness of any required motor vehicle
pollution control device.
(2) To result in emissions from any such modified or altered
vehicle which are at levels which comply with existing state or
federal standards for that model year of the vehicle being modified
or converted.
(i) This section applies to motor vehicles of the United States or
its agencies, to the extent authorized by federal law.

27156.1. The installation, prior to January 1, 1974, of an
auxiliary gasoline fuel tank for use on a 1973 or earlier model year
motor vehicle, which vehicle is required, pursuant to Part 5
(commencing with Section 43000) of Division 26 of the Health and
Safety Code or the National Emission Standards Act (42 U.S.C., Secs.
1857f-1 to 1857f-7, inclusive), to be equipped with a fuel system
evaporative loss control device, shall not be deemed a violation of
Section 27156 of this code. As used in this section, the term
"auxiliary gasoline fuel tank," has the same meaning as defined in
subdivision (b) of Section 43834 of the Health and Safety Code.


27156.2. Notwithstanding any other provision of law, any publicly
owned authorized emergency vehicle operated by a peace officer, as
defined in Section 830 of the Penal Code, any authorized emergency
vehicle, as defined in Section 165 and used for fighting fires or
responding to emergency fire calls pursuant to paragraph (2) of
subdivision (b) or pursuant to subdivision (c) or (d) of that
section, and any publicly owned authorized emergency vehicle used by
an emergency medical technician-paramedic, as defined in Section
1797.84 of the Health and Safety Code, is exempt from requirements
imposed pursuant to California law and the regulations adopted
pursuant thereto for motor vehicle pollution control devices.


27156.3. Notwithstanding any other provision of law, any motor
vehicle of mosquito abatement, vector control, or pest abatement
districts or agencies, any authorized emergency vehicle as defined in
Section 165, except subdivision (f) thereof, and any ambulance used
by a private entity under contract with a public agency, is exempt
from requirements imposed pursuant to California law and the
regulations adopted pursuant thereto for motor vehicle pollution
control devices.
If you look at d you will classify "willfully" specially if you plead guilty to pay the fine...I'm sure they will screw you royally. But that only my opinion. That's why I will always have a spare stock motor in the garage.

You have 2 choices:

1.) Make the car street legal. ALL USDM Type-R parts and all USDM Type R smog parts on the car and take it to the REF and B.A.R. the car.

2.) Pay the bail amount of the ticket and you don't have to go to the ref. Could be from $500-$1500.

Choice #1 is the way I would go, because once you get he B.A.R. sticker, the Type-R motor belongs in the eg hatch. You may have a JDM motor, you just have to have all the USDM Type R smog, ecu, and cat on the car. I have B.A.R'd a few of my cars and its very worth it

Choice #2 is the easiest but you can easily get caught again and you will get the same ticket.

the fine is very expensive , my friend got one was around $ 800 dollars , he just sold the car and went to court and said that he no longer owns the vehicle , the fine was waived

ok...the car is unregistered and uninsured...say if i transfer the title, which I posses, to someone elses name and claim I sold it...will the fine then be waived in my favor?

That is one shady idea!

Anyway..........

You still have to pay the fine. or else there will be a warrant because the the bail (fine) was never paid or cleared.

Sell the car for real and pay the fine
OR
legalize the car and get a B.A.R. sticker
OR
pay the fine, get caught again, pay that fine and by now you could have legalized teh car for a lot less money .

well of course it would be cleared...hopefully...when i am in court i will explain this to the judge...that the car was sold and so on...hopefully then he will clear the fine...its not the only fine on that ticket I have to go to court for

dude your screwed. Unless you know somebody in dmv or know somebody who knows somebody who can get you a temp registration (permit) sticker for you to take to court with your vehicles information...you are mad screwed that selling bullshit won't work cause you were still driving an unregistered vehicle. Judge won't give a damn if you sold it a second ago or a month ago. The car was unregistered period. If somehow you did manage to get a temp permit then make a fake insurance card (nobody will give insurance to unregistered vehicle so don't make a fake one unless you can show some kind of valid registration). This is only option otherwise BIG POCKETS!
But do get the bar...that's atleast one fine down.

ok ok ok first off i owned the car for less than 30 days, so i was not given a ticket for no registration...you have 30 days to obtain reg./insurance/etc...i was given a ticket for no proof of insurance...I have insurance, but no proof on me at the time...so the insurance ticket is no big deal...already called the court house and they said just show your insurance card to the clerk and that ticket is written off...and i wasn't given a no registration ticket because of the less than 30 day period i owned the car...if i was caught after the 30 days of owning the car, then i would have been screwed...I'm just gonna get the car BAR'd, but i was just exploring other options...btw, don't i have to convert alot of crap under the dash concerning wiring for the conversion to OBDII?...i was told that is a real bitch...thanks for all the help guys...

First off the Judge can do anything he or she wants. 80% if you sold the car you will be waved the fine due to you no longer own it, just as if you got the car legal smog the judge would wave the fine. Secound you can pay the fine but i would rather sell the car or bar it. Once bard your set. Just take off any bolt ons without CARB stickers and see what happens. Do it soon though because your not to drive your car now. They might take it next time your stopped before you fix it. I just got my tx from the haters and going for the bar this week. Shouldnt be so bad i got a 94 JDM GSR in a 94 coupe. All stock. Only fuel regulator that i will have to take off no biggy. WEll see..
