Clutch Question

Ill try to make this short and sweet, I have a Action 2 MD unsprung clutch from Kyle (2K_TEG). How come when the car is off and the E break is up, I can put the car in gear without pressing down on the clutch pedal?
With my old stock clutch, I always had press the clutch in and then it would go into gear. Someone told me it has to do with the "gears lining up", but some how It seems "weak" to me.
Sometimes it goes in gear without the pedal pressed down and other times I have to press the clutch and then put it in gear. Remember this is when the car is off and parked.

you can put it in gear with out stepping on the clutch when its off. normal.

because nothing is moving in the transmission.
or why couldnt you with the last clutch?
that i dont know.
