Default Tranny whine came out of nowhere

I did search but noone had the exact answer from my quick skimming.

I was driving towards downtown today in 3rd and out of nowhere a whine started. I completey freaked out because I thought I finally had my car running with no problems.

Symptoms:

Whine increases in speed/sound as Rev's climb
There is no whine when not in gear
Only whines when there is load on the tranny
no whine when revving car in neutral.

Now, I know im a BIT low on oil (maybe 1.7L instead of 2.0L) in my D16Z6 TRanny and I'll be doing a complete flush/replace fluid on it to see if it'll get rid of my whine.

Does anyone know what it could be?/

When the clutch is pressed in the tranny makes no noise.

When the clutch is not pressed, tranny makes no noise ONLY in neutral.

When the cluch is not pressed and in gear, tranny makes whining.

Is it safe to drive my car with this whine? Will it damage my transmission?

i had this same problem in 1st and 2nd gears very faint whine, no loss of power either.

this problem came about then i changed all my bearings from the transmission.had enough oil. it was disassembled about 7 times, trying different things to find out what the hell the whine was. no jarred gears, or teeth and everything lined up great.

it came down to a shim replacement, on the differential which youhave to measure correctly. the helms manual goes through how to measure which size shim to get.
you can drive around with it but if the noise gets louder you will have to make some changes but if the sound stays the same just live with it and put some money away later on.

Ok well the noise has gotten significantly quieter. I can barely hear it in 1st and 2nd anymore and 3rd gear noise is pretty much gone.

Im going to replace my tranny fluid tommorow as it needs it(I know it for a fact).

Is it safe to still beat on it?

Edit: Also, the whine does get louder as I climb revs, but tends to dissapear at what sounds like 3800-4200RPM....any ideas?
