Default Speeding Ticket Questions

I got pulled over yesterday morning by a cop in Boulder, CO (anyone that lives in the Boulder area knows that these guys are a joke) claiming that I was doing 55 in a 35 zone. First I cannot have been going more than 45 (compression braking as the speed limit was dropping to 40 and then to 35). Second, after 15 min of arguing with this guy he finally drove back about 100 ft to check the limit and realized that it was 40.

I asked to see the radar gun because I knew that he never gunned me (my detector did not go off once that morning) and he told me first that he had paced me at 55, then at 50. My question is would it be worth it to fight this one? I have one previous speeding ticket for 10 over on the highway about 8 months ago, and no accidents. Because I have one previous ticket this is going to cause my insurance to go up.

fight it. its better then just paying up. and trust me, anything is possible. just say the right things to the judge and prepare. oh and postpone the date a good 3-4 times.

well, im not sure about CO but in TX you can take defensive driving first and then get deffered ajudication(sp?) so you should just take deferred and cut your losses.

How long did he pace you for? I think there's supposed to be a specific distance for a reliable pace. Something like 1/4 mile or something.

ill let all of you guys in a little secret, some of you probably know but here goes. i was told by a former police offer here in jersey that when u pay a sppeding ticket or a ticket with points you pay five dollars extra. they then will send you a refund check for that five dollars. dont cash it because once you do they recive confirmation that the transaction has completed. and therefore it know registers in the computer that u will know have points for the violation. is a little confusing but it does work

That doesn't work. They will gladly take the extra money.

and I had never received a refund check.

He paced me for about 100 feet, just around a shallow corner. As I mention before I know that he did not gun me. He threatened me with a Reckless driving ticket. I don't know how he would have justified that, when the most he could have got me for was 5 over (45 in a 40) on an empty road at 7 am on Saturday.

dear oh dear... looks like the piggers are revenue raising all over the westernised world.
same problems in australia.

got pulled over the other day because it "looked" like i was going fast.
i **** you not, i asked the guy to see my readout and he didn't have one.
he realises he can't get me for speeding and starts checking my car for defects... nice
didn't get me for anything though.
i guess having the car stock has it's advantages.

Ha ha... I just had the same thing happen a few weeks ago. Cop going the opposite way on some tight S-Turns, turns around to get me. Cop pulls me over and goes "It looked like you were going a little fast coming into the town." I silently smirked and couldn't wait to take that one to court. Fortunately, though, I didn't have to waste my time. The cop was friendly; just ran my license and let me go.

just take defensive driving class. it should dismiss the ticket and just chill on speed for 1 year.

but also if you go to court you can plea bargin and they probably make u pay an 50.00 fee and 1 month probation. but hell it beats the heck out of gettin a ticket and then slaped on top of your auto insurance.

i just got caught speeding the other day, i was on the 347 and was following traffic, no weaving in and out. a cop pulls me over saying i was going about 75-85 and he was pacing me for 3 miles...my question is the reason you have to stop speeders is because theya re a danger to other motorists, so how can this cop in his right mind, let me speed for 3 miles, if i was speeding....anywyas, im going to court and i have a slip saying that my speedometer was broken, (it really was) and my friend is signing a deposition saying that the cop was not "sure" of what speed i was going....

Thanks for all your help guys. I am not sure if CO offers a defensive driving course, but I am willing to do just about anything to keep this off of my record. I intend to fight it, but if that doesn't work then i am going to plea bargain or take a course.

Does anyone know if there is a defensive driving course offered in the Denver area?

Heres something that may help. If a cop measures your spped (gun/car whatever)then by law in the UK you have the right to ask for the calibration certificate. If it cannot be produced on the spot then you are free. However remain polite and make sure your car is not missing anything and dont smirk when you ask as they go barking mental when they get asked and cant produce it then turning to anything to nick you. As for your case, get legal advice as he sounds full of it, never heard that before "you were going too fast because i said so" fuxk off, just unreal

Take it from someone who's insurance has been over $350/month (until recently, yay!) -- fight it, delay it, get an attorney, take defensive driving, etc., whatever it takes. Because once you let a couple go on your record, it becomes increasingly difficult to convince prosecutors/judges to cut you slack later. At one point I had 24 some points on my record and a deal with the state to drive clean for 6 months or lose my license for a year. It all started because - well let me interrupt, because I'm a dumbass first and foremost - but because I let one ticket go on my record that could have easily been kept off... then I got another ticket soon and in an accident, and well the rest is history. Long story short, it's been 1-1/2 years since I've had a ticket, and my insurance is still $175/month. It will drop again in February though, provided I keep my foot of the gas (or in the case of my ZX6R, my hand).

So lesson be learned, whether you plead guilty, pay fines, or whatever, do whatever you can to keep those all important "points" off your driving record!

[edit] oh and - do what I did, (if you're not already) get involved in autocross, club-racing, drag, whatever... cause if you're like me, and speeds a problem, taking it to the track a couple times a month really helps keeping it off the street!

it does work guys ive done it myself twice. this was three years ago!!! im sure in new jersey it works. i have no points on my record!!

first postpone that damn thing like 2x's!!!
then fight it!
give yourself time to one let the other drop off/take a 6hr course
and give him time to lose the paper work...

i got off 2 tickets this way.

if the above is not an option then plea bargain.

if you cant do any of these fight it.....ALWAYS fight it!

ALSO-
i have heard of the pay extra and dont cash the "change check" the myth is that the points dont hit till the refund is cashed. To my knowledge the person who this worled for is unknown.

Pacing is dependant on the state..
I think its 1/2 mile if you are travelling above 50 MPH
100 ft wont cut it..
