Default Legal question for you???

soppossed you were parked next to your friend. You go to back up first. when you are behind his car at a stand still while you are shifting gears, he puts his SUV in reverse and backs up into you.... would you consider this his fault or yours... assuming that it is his fault and then he even says i didnt see you there and all the excuses... would you expect him to pay for the full repair or only half the repair... what would you do if he felt he had to only pay half... would you screw him even if he was a friend...

What would you do if this was you in your Teg...

How long did you park behind his SUV?

Just enough to shift to 1st, and then he backed up. Or did you dick around and change cds, etc..

I would turn it into insurance and let them decide. We have insurance for reasons like this. If you guys are real friends this will not torch your guys friendship. That really sucks that had to happen . Hope it comes out all right.

if he back into you then its his fault he didnt clear the right-of-way. go talk to your insurance agent and file a claim ASAP and get this on the books!

when you pull out of a spot, it's your responsibility to look behind before you do - obviously he didn't so it's his fault.

jesus! don't get insurance involved for an accident between friends! (unless it's really really bad or something) make him pay 75% and tell him you'll pitch in 25% because you're upgrading to tricked out nsx vents

and i wouldn't screw him because i just don't swing that way (not that there's anything wrong with that)

He didn't check behind his vehicle before moving. It's completely his fault. Would the excuse of "I didn't see you there" work if he ran over a person?

I would do one of three things if he's your friend. And he will if he really is a friend.
1)expect him to either pay cash for the repairs if he didn't want to report it,
2)have his insurance pay for it and then he doesn't have to pay out too much either
or 3)report it as a hit and run and have him cover your deductible and have your insurance pay for it.

yep his fault, if the guy is really ur friend then he would be willing to pay for the repairs in the first place, if he doesnt wanna pay for his mistake then really isnt being a very good friend himself and u should dick him over hard, i would offer to be fair about it like take the lowest estimate or try to find someone to do it on the side or somehting but he should be willing to pay for being a retard, later

I would think its his fault. You were "in the roadway" so you have the right of way. At least thats the way I look at it.

If you were screwing around behind him for a long time the insurance companies will probably put it at equal fualt and you each pay for your damaged cars.

I agree, there's no excuse to hit a car when you're backing up (unless of course you weren't looking, or was talking on the cell). Leave the insurance outta this dude, it'll be a freakin hassle and can mess up even the best of friends.
