Cusco Catch Can Questions

Alright, I know this topic has been beaten to death, but most of the pics and stuff are dead in the other posts. Not only that, but there is a lot of speculation and not a lot of people that seem like they know what they are doing. So here are my questions.
Oh and before anyone tells me to search I just sat here for about an hour and a half reading all of the old posts.
I got this as a gift and would like to use it, but if there proves to be too much modification needed, or if this thing doesn't do anything but bling, then I am going to get one that works.
Questions:
1. There is no breather or filter on top of the cusco can, is the breather necessary?? How does it help?? and is it illegal for CA smog if they see the filter??
2. Is the cusco can baffled or not??
3. Is the cusco can useless bling? or does it actually function as well as some of the others out there??
4. Is there any way to use the brackets given without relocating the battery??
-I really don't want to hack this thing up, but if it doesn't do anything the way it is, I just might.
- If this thing is completely useless, don't hesitate to give me your opinion. I just want to know if this thing is worth my time, or if I should get a different one. I am sure my friends won't mind me trading this one to get one that works. It was a great idea, but I just want to make sure all my time and effort isn't being wasted on something that doesn't do ****.

1) Breather is not necessary if you don't plan to vent into the atmosphere, I'd like to believe in Cali they would NOT want you to do that! Venting into the atmosphere is for race application where emissions don't count.
2) The can is not baffled
3) I'd say it has the same function as a custom can made out of a coke can
4) It's a JDM piece, with some tinkering, you could probably figure out how and where to mount it.
I knew somebody who opened theirs up and stuffed it full of steel wool before mounting it back into the car. I certainly wouldn't buy one and hack it up, but he was just as fortunate as you and got it as a gift. 2hours or so of his time and he had a good catchcan.

On http://www.c-speedracing.com they show an SRR can they baffled and instructions try them out. I've had a Greddy catch can and I could see oil coming out of My (brand New)PCV going toward the IM with the catch can in you could see oil from the PCV to the can (little amounts of oil in line) and the Can to the IM (clear) So im guessing it does its job
Doesn't work as well as a baffled can but it still works. I can fill mine up after 2 track days. Installed between the pcv and intake manifold. Couldn't figout how to use the brackets so i made my own crappy one, but at least it works. Just had to move the wire harness over.
its useful enough for me.. i now see how i used to burn oil..
i could also see how manufacturers woudln't want to do something like this even if it has no filter.. - more maintanance that people woudl'nt want to deal with periodicaly..
i'd rather stick with air and fuel mixture only..and keep the oil where it belongs..
