ok so let me start off with the story, i was on my way to englishtown today for summer slam when at the inter section of union and peshion a lincoln blackwood runs the stop sign so i wound up literly havin to drift between him and a wrx wagon to not hit anyone. so i didnt hit anyone but wound up hitting a curb and ****** upthe front end of my Eg. the guy in the blackwood then decides to take off down union to leave the accident, my friends followed him to get the lisence plate. when the cops got him he wound up assalting one of them and got arrested, so my main concern is can I HAVE EITHER HIS INSURANCE COMAPNY PAY FOR MY DAMAGES OR SUE HIM TO PAY FOR THEM EVEN THOUGH THERE WAS NO DIRECT CAR TO CAR DAMAGE?? im really lost on this right now and was jus wondering if anyone had any advice

 

Most likely you will have to sue, as it doesn't sound like the guy will admit his guilt or even partial responsibility. Typical law-school example... even though it seems like it was his fault (failure to stop, negligence), you were the one who decided on further actions, and chose to hit the curb instead of his vehicle. Many lawyers will argue that you are the one responsible for the damages.

I hope you have a good 3rd party witness and a better lawyer.
