Default Bad ECU? VTEC surges and cuts out intermittently......???

Ok before I say anything::

I HAVE OIL.
NO CEL'S
All wiring is OK

I have a p28 with HONDATA. vtec surges as it pulls.... It like cuts out intermittently. I have heard of this happening on stock ECU's and Hondata ECU's. So I am very confused.

This guy has the EXACT same problem as me:

"Actually I think I may have figured the cause of the problem.
The ecu and vtec work fine - but only when driving very very mildly. So, I'm saying that if I drive down the road and I'm just cruising normal, and then decide to wind out a gear - the vtec will work perfect.
But... If I'm in vtec for a long period of time and I'm driving the car very hard the vtec will start to cut out more and more as I drive it harder and harder, until finally it throws a check light and I have no vtec at all.
Let the car sit for 20 mintues or so and go out and then drive normal, wind out a gear... vtec is fine, works perfect. Then start driving hard and it starts not working again (studdering and cutting out)"

SOMEBODY PLEASE HELP ME. THIS IS BECOMING FRUSTRATING
