Default Problem with 5-speed Back-up light switch

I just noticed today that my reverse lights turn on and off at times while driving. I thought the switch was faulty at first but then I pulled it out of the transmission and left the electrical connector plugged-in still and the lights no longer came on. If the switch was faulty wouldn't the lights still flash on/off regardless of if the switch is in the tranny or not? If I pull it out and manually push the "button" on it the lights act perfectly normal. Also, I was looking for a replacement, is there supposed to be a washer on it and could a missing washer cause it to hit the fork shaft making it active before it's even in reverse? I noticed mine doesn't but on Hondapartsnow.com it shows a washer.

Get a washer and make sure it's tight. Then see where you stand.
