Default Help WIth tranny..

SO less then a month ago, I rebult my accord lx motor. While doing so, I replace the two axle seals and replace the oil in the tranny. Three days ago my brother calls me and tells me that my car wont stay in 5th gear (keeps popping out). Meanwhile he decides to keep driving it, then yesterday he had to get it towed to my house because it cuts off whenever you try to pull off. Even when it seems as if its in N, they car stills wants to pull off, but cuts off when you are completely off of the clutch.

So I figure that the tranny is completely shot. So today I start preparing to pull it out and when I got to the axles no oil pours out. So I unscrewed the drain bolt and little to nothing comes out. So I filled the tranny with oil and drained it to see if there was metal shavening, and there was none that pour out with the oil. So am I safe to just putting everything together and fill it up with oil? or Is the tranny shot and should just replace it?

do you know of n e cases, where sometime like this happened. If the tranny runs dry on oil and locks up, that it may still work? The tranny is pretty much ready o come out tomorrow. I will hate to put the axles, suspension, etc.. back together and it dont work!
