Default blown headgasket? pics inside

new motor from nippon motors jdm d15b sohc vtec, motor was purchased with a blown headgasket in my opinion and is going back.

original thermostat from thermostat housing (since been replaced)

water in my radiator shooting out my exhaust (no point in buying coolant unless i want white smoke instead)

and what sounds like water falling on the last part of my headers (downpipe)

ftl

That looks like a rubber garmet. You sure that came from the thermostat?

that looks like someone twisted the thermo stat part out of it.

is it worth it to send it back instead of repair the broken gasket?

That looks like metal to me. Not rubber.

my guess is someone took it out because it was overheating. and its metal not rubber, im sure of this... no its not worth replacing the gasket, its worth replacing the motor because im not sure how damaged everything is and im not risking it. but it seems to my that the head gasket is blown/damaged, correct?

Radiator cap? How would that allow water into the exhaust? give me a break.. send it engine back. Don't waste time on an obviously abused motor.

They were just looking for an excuse! but I'm super surprised someone even showed up! Sorry about the intake issue, but I'm sure it's in there fine print somewhere.
