exhaust sitting on rear sway - bad or ok?

Default exhaust sitting on rear sway - bad or ok?

i just bought an EK hatch at the beginning of this year (my first hatch) and the previous owner told me that he put on a CTR sway bar (from what i've heard it's a 22mm?). when he sold it to me there was no exhaust and i'm just now getting a catback system for it. the piping is 2.5 mandrel.
so i get the catback piping on and all that is left is the axleback. i take off the rear right wheel to put the exhaust on and start to get the exhaust bolted up. the exhaust piping ends up resting right on the rear sway bar. no way to move the exhaust at all, even when i don't have the rubber hanger pieces from the muffler onto the car. the exhaust doesn't budge a half inch.

prior to the cat back i tried installing a 3inch thermal axleback, but it didn't work out because of the stock piping. the thermal was somewhat on the sway bar as well.

my question is will there be a problem if the exhaust is on the sway bar? i don't track the car, it's used for daily driving. should i place something between the exhaust piping and the sway bar? the car seems to rattle a lot when shifting. i'm not sure if it's the exhaust on the sway bar or the exhaust hitting the heat shields.
