My 03 got rearended the day before the Superbowl. Almost a month now, and nothing from the "idiot girl talking on a cell phone"'s insurance company. All I get is voice mail, and I need pictures, I need estimates, and a lot more voicemail. I hate to complain, but life is a bitch. $4,000 worth of damage. She shoved her Galant under my trunk. The only good thing about it is, HER CAR IS TOTALED!! Noone was hurt.

Sounds like it's time for your lawyer to send the insurance company a friendly reminder letter.
*L*Hows your neck doing.It's to bad you can't hardly work since the accident with all that pain.And what about the night terrors when you wake up in a cold sweat reliving the horrible accident?

You deserve some kind of restitution.

That would all be cool, if I was in the car at the time (wife). Our insurance company is going to try and get her insurance to pay up. If not, we will probably have to pay a deductible for our insurance to cover it under the uninsured motorist.

depending on the "quality" of your insurance company, they already should have told you that you have the option of going through your own insurance company, or going through her insurance company.

go through yours, pay your deductible up front (your deductible for recovery/repair of damage should be the same whether it's uninsured or insured, provided you actually have coverage for uninsured... which is irrelevant here as the other driver is insured), car gets fixed, insurance company tallies up the total, all the meanwhile investigating the claim. figures are calculated, your insurance company goes after hers. the other insurance company agress to pay. you get the deductible back. it may be well over a year before you get the deductible back.

go through hers, wait wait wait wait. if the other insurance company asks for pictures and estimates, you need to go do it. it's not that difficult. once i was in an accident, not at fault, i took 3 or 4 pictures, obtained 3 estimates, the other insurance company gave me the highest of 3 estimates.

if you sit around and do nothing, don't expect much to happen. be a bit proactive about it, and things will start to happen.

when i got in my wreck, the other insurance company tried this crap, but when they found out that myself, my lawyer, and my insurance company were all after them, they just decided to pay me up front.

i managed to get 3200 bucks for a 93 civic lx with 210k miles on it.


so i would have your insurance company go after them, as well as a lawyer, and keep pursuing it yourself...if they give in to you, you can always drop the claim with your insurance and keep your deductable

We decided to go through our insurance company (we have uninsured-underinsured). When we did that, our company called her insurance company. Not 30 minutes later her insurance calls us, and Say's the check is in the mail. So hopefully the "check is in the mail" line was not just another stall tactic. And yes, we did send her anything she asked us for (pictures, estimates, etc.). But we would make one call, and it would be days before she would call back, or answer her phone. Safeway insurance = No good.

We have been involved in two other accidents where the other driver was at fault, and never had this type of problem. Two weeks, was about how long I figured it would take to get the parts ordered, not a whole month just to get the check. I just kept thinking they will send the check today, tomorrow, then by the end of the week. But as the days went by I got more and more tired of waiting. I heard all the stories of insurance companies giving people the run-around. Until now it hadn't happened to me.
