Got a ticket today for modified exhaust / too loud!

Default Got a ticket today for modified exhaust / too loud!

I was driving home today from work and notice a CHP car following me from the 605 south to 105 west. Well after 2 miles he decided to turn on his light. I thought there was some traffic call. I had no clue that it was for me until he flashed his head lights. I pulled over to the side of the freeway. At this point I was completely confused as to why he pulled me over, I wasn't speeding.

He comes up to me and asks me if I modified my exhaust sytem. I told him no, it was not modified. He then asked me for my license and other paper work. After that he didn't say a word to me, he took my papers and walked back to his car and partner to write me up.

He finally came back and handed me my ticket. So I asked him why I got a modified exhaust ticket. He explains that my car was loud and raspy. I asked him, how can you hear my exhaust at freeway speed and all the traffic around us? All he could come up with is that on the transition between the 605 and 105, I slowed down enough for him to hear me. I started to argue, but stopped myself for the fear of getting shot or arrested.

My exhaust consists of:
JDM DC header
2.5 exhaust piping
Mugen Muffler
Mugen Muffler
Mugen Muffler

Did I mention that I have a Mugen muffler! I know my car is louder with the 2.5 piping, but nowhere near 90db. I was shocked to say the least. I think he profiled my car. I have race seat with shiney tie bar. I am sure that caught his eyes, cause my muffler is so dirty, all you can see is the hole in the muffler.

He must have thought I was a ricer, but I don't see how. My car is 1.5" lowered at most, also I am 30 years old and balding.

How do I fight this injustice! Some one help!

I'd fight it, but you shouldn't have told him you hadn't modified your exhaust - that could come back to bite you...

First of all he asked me the question, should I have lied? I didn't modify my exhaust. I replaced the stock stuff.

LOL!! He probably didn't notice that you are 30 and balding until he pulled you over... Seriously, how in the hell do you get a ticket for "too loud" exhaust when you have a Mugen muffler?! Do you have a cat or test pipe? Is there a resonator in that 2.5" piping somewhere?

I have a big *** resonator and test pipe, but the test pipe didn't make my car any louder compared to my 2.5" carsound cat. But it is much louder than 2" stock piping with the Mugen. My car is not loud, no where near 90db!

I am greatful that I didn't get caught for running a test pipe. I just put it on for dyno purpose, but got lazy and haven't replaced it yet. You know what I am doing this weekend

How can I fight this ticket?

dude contest your ticket. since cops didnt test your exhaust with a db meter, he can't claim ****. especially since you were on the freeway. go and get your exhaust tested by a sound shop first to see you are indeed within the legal limits, then go and take it to the damn popo station and have them test it. once you get the results, take that **** to court and the judge will definitely rule agains the profilin cop.

But you did have a modified system. You said no and he probably thought, "yeah right" and wrote you up. Maybe if you're straight up, he might have been easier? I dunno.

You guys w/mod'd exhausts might need to carry sounds meters w/you!

I did not modify my muffler. It was replaced with a different exhaust system. I think that makes all the difference in the world, because modifiing an exhaust system is illegal.

Replacing it with a NON-OEM one is also illegal. They can screw you almost in anyway they want.

I recommend to go to your local CHP office and ask them to test the sound of the exhaust to see if it is too loud. if it is then change it and lie, otherwise fight it and make them feel stupid. I hear most of the time they do not show up for court.

Heh, guys I tried contesting my ticket w/ my apex n1. No go. I had a court date setup and everything. Showed the judge the paperwork (What bob linked to, and that SEMA ****), and she said that none of that **** was substantial because she had her OWN rule book that was given to her from the government. And since that paperwork wasn't IN the rulebook at the time, it wasn't valid. Maybe it's passed since then and is in the newer `02 rulebook. **** CALI COPS. That's all I gotta say, nothing better to do than harass people.

As for Cheap Bastard, take it to a stereo place, and have it db tested. If it's not near 95 db from I think 15 feet away between 3000-5000 rpm then you're good to go. I knew mine wouldn't so I didn't bother. Hopefully yours'll pass. Just fight the ticket, worst you can do is just pay the fine and that's it. Also just wondering, did the cop mark FIX-IT or Not correctable? One of my girlfriends works for an insurance company, and said that all these little fix-it's are no more, and they're going to be actual violations which means Points

It will definitely pass the db test. I am not worried about that. The ticket is also marked as correctable so it's just a fix it ticket. I still wonder why he pulled me over. I think I will enjoy going to court to clear myself of a crime that is clearly unwarrented.
