I'm not sure where else to post this, so if this isn't acceptable please re-direct me.
Long story made brief: Bought a 5th Gen from a car dealer, weren't told that it had been purchased at a junk-yard and rebuilt. We are now suing the dealer. In the meantime, we have to get rid of this car (need a family vehicle) but I'm not sure what is a fair price to begin negotiations at. We owe $4k, and I know we won't get that as is. The transmission needs replaced, and there are a couple of minor issues with the motor that we could fix for under $200 - we haven't because we aren't driving it due to the tranny. The body and interior are both great, no issues there. Fresh paint job. Recent tune up. We can replace the tranny for about $1200 after purchasing one from H Motors and with a shop installing it. (It's auto, I know everyone here hates them, but we aren't going to put the money into it for a conversion.)
So. If we don't replace the tranny, what might be a reasonable place to start negotiations? If we DO replace the tranny, same question.

i would be hauling it back to the dealership and droppin git off right in forn t of the front doors, so close thet the front end would block the doors form openeing. then i would go in and demand my money back, you were defrauded man, and taht is not cool, a rebuil;t ittle is worth half what a good title is worth, its unfortunate.

if he bought the car fomr teh dealership and they sold it as a used car, and never informed him the title was rebuilt, that is fraud. I dont knwo about the states, but in canada, once the title is rebuilt, it cannot be "certified used" as the dealership writes the VIN number off as destroyed car.
A repossession is a huge difference than a rebuilt title, a rebuilt title means that the car was so severly damaged that the insurance comany wrote it off as a totalled vehicle. It doesnt matter allot if its rebuilt, but if the dealership sells it as a rebuilt car, and doesnte xplain that the title had already been written off, then yes it is fraud.

Bouckaroo and Integra 101: We are suing the dealer for breach of contract under the UCC, Unfair and Unlawful Practices under the Consumer Protection Act, Misrepresentation, Fraud (for willful failure to disclose a totaled vehicle), et cetera. As-is waivers do not apply when you are unable to know the particularities of that which you are waiving (such as a latent material fact that greatly reduces the value of a product - please see Testo v. Russ Dunmire Oldsmobile). Thankfully I work for an attorney so I have my bases covered on this one and we do actually have standing to sue. Not that any of that matters for the value of the vehicle. Just saying I'm not going to play their game, I'm going to hand their asses to them to the tune of treble damages.

^good for you!!! I am glads to hear that as so often people in the community(especially the prelude community get ripped off by other preludeowners (guys who buy stuff cheap then artifially jack up the price......)) and never get anyhitng back or have it resolved.

also, i know you said you didnt want to spend moeny on a swap, but have you considered havving the auto trans built by level 10? they build these trans to be bulletproof, and it will remiain auto.

We actually intend on dumping the car as soon as we can get the new transmission into it so we don't want to spend more than we absolutely have to get her up and running again. Once we swap for a good transmission there will be very, very little wrong with it (minor mechanical issues we can fix in a day). Whoever buys it will have a strong running car since we have spent so much time and money fixing the darn thing. However, hubby and I are getting ready to start a family though and since there is no room for a car seat in the 'lude - she has to go. Thanks for the extra suggestion though! If we intended on keeping it we would certainly consider it further.
Integra 101 that is what we found out after having all the shops around here quote $2-$3k (and one telling us to just walk away from the car... yeah, cuz that is a good idea when you owe money on it). Thanks
Hmmm, you know, depending on how fast you wnat to fix the car, go on preludeonline and look up member danieljonston 27 i think his name is, this guy specializes in prelude SS trans reapirs and sells whole units cheap, as logn as you can send him yours. He is a rgeat guy, very skilled and is always lookign out for those who own the ss ludes!!

Who pays more than $4k for a minimum 12 year old stock, auto, Honda Prelude? The VIN is right there in plain sight and there are many tools available to the consumer to look up the car's history. Had she no suspicion of its worth or was it just blind faith? Also who buys a Honda Prelude for a "family car?" It sounds like maybe she bought the Prelude a while ago and now she "needs" a family car? Like that $30,000-to-term, 9 month pregnancy snuck up on her?
So her naïveté got the best of her and she's suing the dealer after the fact? I'm sure I don't have the whole picture, but that sounds to me that you're enabling her to be the victim and you're going to take it out on a business, not just to recover from a complete lack of due diligence, but to punish the dealer too?
Either have her take responsibilty for her own decisions or work with the dealer or other sympathetic shop to get the car running again. Blame is not black and white... Maybe save that $600 shop tab and help her turn her own wrenches? You both might learn how not to be taken advantage of by unscrupulous dealers in the future and learn a skill that has more social merit than " sue-happy lawyer assistant."

The reasons he has to sue is becuase the dealership wont give her refund. When they shoudl as they are entirely in the wrong for not disclosign the truth abotu the vehicle. The reason they did not disclose that is that they knew they wouldnt make the sale had they.
So with this said, suing is a prefectly accetpable methods of refund extraction, after all thats why the system is there to prevent thigns like this from happening.

It's the internet and I thought that this was a "tech" forum, I must be mistaken though. I'm allowed to maintain my non-constructive, topic-parallel yet still non-tech related, dissenting opinion about the inane behaviours of others when openly solicited for opinion. I intelligently (see the nice words and decent grammar?) and constructively stated that a refund alone should be sought if other avenues were exhausted, and that they should expand their skillset beyond taking dictation for a useless lawyer (won't someone please think of their children!).
I'm not sure why you're so quick to defend the OP unless you're getting something out if it. So feel free to pipe-down unless you want to talk "technical" about Preludes. Go ahead and get in the last word now because I'm done.
