Depends what else have you done to your car? (Swap, Cat, etc........)
I have an RS*R Exhaust System since 1995 on my Civic and I pass every 2 years with no problems. And that's with DC Header, AEM Short Ram and stock Cat.
If it is just the Exhaust, I cannot see why it won't pass.
