That's a shame. What will be the insurance/liability concerns ? Car is modified, was the temp spare on the right rear at the time of the accident ? Braking distance affected ? More important was anybody hurt ? Pics may not be your friend in a lawsuit. Good luck.

Unless the other car was in reverse or heading towards him, it appears the OP is already at fault since the damage looks like he/she rear ended...a truck? Looks like the impact beam is still reasonably located where it should be while everything above it is smashed backwards.

I hit a Scion XD. My car was much lower then in the pics in the parking lot, I think that's what saved her ***, as her car had nearly no damage, you wouldn't believe by looking at my car that she was who I hit. I think my car hit her bumper just below her support beam and pushed her car up more then anything. Hard to really say though it happened so fast. I would have swerved into the right lane to miss her but there was a car next to me so my only option was to grab a hold of the steering wheel and a split second to prepare for impact. She was at nearly at A dead stop and I was at roughly 45-50 mph when I hit her.

Ehhhhhh you were probably not going anywhere near 40-50mph. You'd be dead AF. That looks like maybe 10-20mph damage.
