Is this a safety issue, Honda can address?
All my warranty has expired back in 08?
Basically, when you adjust the seat forward and backward, the right side doesn't lock in and it's wobbly. I have no idea how it got like that. Just today it became like that. Is it out of sync?
I haven't really taken a look yet.

Is it the powered seat or the manual lever adjusted seat?
If it's the powered seat, I don't have any info for you.
If it's the manual seat, than here's the solution:
Once you've adjusted the seat to where you want it, push "down" on the lever and move the seat forward and back a little to make it click and lock in.
I have to do this every time someone in my passenger seat wants to move it or someone gets in the back of my 2 door.

For manual fore/aft sliding seats, the lever operates two rotating "forks" that engage slots in the slider tracks to lock the seat into place. My best guess is that the rotating fork on the right side of the seat needs freed up and/or lubed to move properly. Bear in mind that I'm basing this assumption on how the seat sliders worked in older models; I have yet to take a seat apart on an '03+ Accord so the mechanism may be different than what I am describing.
Remove the seat from the car and flip it over to get a clear view of what is going on underneath. It only takes four bolts and a couple of plugs. I would suggest disconnecting the battery for a few minutes prior to beginning work and reconnecting it only after plugging the seat back in to avoid problems with the SRS system.
If your warranty is expired, Honda will likely not cover it, although you will never know unless you ask. Dealers will sometimes goodwill a repair if you're an outstanding customer and/or they have approval from Honda. The only safety items that are covered under warranty for the lifetime of the vehicle regardless of age & mileage are the seat belts and buckles.
