Hey guys I need a little help. I'm working on getting someone to drive my
car for me while I'm on the mend. The world we live in makes me have to ask
this question. What happens if everything goes wrong, the driver breaks a axle
or something and hits the wall at a zillon mph and dosn't walk away. Is there any
way to protect myself from the law suit his family is likely to file?
There must be some kind of standard waver for this kind of thing.

i would say to print some sort of document that states the driver and his family..etc...whatever can do nothing about _____ whatever happens when he/she is driving the vehicle.
take it to a notary and the both of you sign it and get the document notarized for legality.

Like i said before if you are that worried don't let no one drive the car . With a waiver signed the family still can sue for negligence. Now whether or not they win is a different story, the judge will decide!!
basically you can set it up like the nascar guys do. none of them own any of those cars. just write up a written agreement stating that you won't be liable for certain things and you right those certain things down and that person sign it. you can also include any conditions that you feel you need to protect your investmen.
As far as the parts issue....thats all part of being a team owner/car owner if something breaks then thats something that would come out of your pocket. BUT i'm sure the person you inquiring to drive for you will be more than willing to pay half for all expenses
Also, you may need to go over how the winnings will be dispersed or spilt up. you'll have to put that in the contract also. that the winnings will be split between both parties or that the winnings will go back into the car and so on and so forth.
And if that person feels that the contract will benifit both parties and not be a one sided deal, then he should have no problem signing.

thats not true. that why you sign waivers when you enter the track. it wouldn't be negligence if you are knowingly doing something that you know can be dangerous. so by signing a waiver,makes the 1st party(being the track owner) not liable

I think I'll call my local track to get some advise, I'm sure they have been though this already.
I wonder what teams have paid drivers, Venom, GM, I think AEM owns

Depending on who you have insurance with when you loan a vehicle to someone your insurance will cover that persn the same as they would over you as a Permissive User but most contracts become Null and Void once you are racing at a sanctioned event or even any speed contest ie street racing. The waiver signed most likely would not hold up in court anyways, I have seen signed statements and notarized at that not meaning **** in court. You know those waivers people sign when they skateboard on someone halp pipe/mini ramps that they are not liable, nope you are liable. Just a reality of the world.
2.2L Civic is on the right track. If you want to find out a real answer you could contact a lawyer and just have them steer you in the right direction. They won't charge you for that. Or you could call a local university and contact a law or business law professor and ask them...90% of the time they are practicing lawyers.
If you wrote a contract and this person signed it, and there was a witness, and it was a legal document, you should be fine. This person is taking an assumed and understood risk. Its just like stepping onto the football field.
As far as negligence...the only way I could see this happening would be if the car was not safe or had a part fail. But if it had passed an NHRA inspection, that would play on your side.

thats bull... its just like in nascar when a tire flies into the crowd and hits and hurts or even kills someone. you don't sign a waiver at nascar races, but if you look at the fine print on the back of your ticket, it says that by purchasing this ticket,we(the track) are not liable for any injury or damages sustained to you while you are at that specific event.

Hey Steve, damn man, sucks you have to go through all this. Its a real tough break. Ill drive your car at NHRA events, hehe. And as dave 2.2 stated earlier, a typed up paper with both your signatures and have it stamped by a notary public, that should suffice.. Good Luck Steve

I found out today that the Dr. that's working on my rehab is a X drag Racer! He
seems to think I might be back in the seat sometime this fall!! Kinda funny, he
used to run a big block Chevy, just can't beleive a 4 cly can out run his times
by SO much!
This legal stuff is just ****, but my wife thinks it's important and I guess
she has a point.
I'll call the lawyer and get the paper work done.
Sounds like there won't be a shortage of drivers for it, just buy your E ticket
at the booth sign the waiver and go play! First person in the 9's get the BIG
stuffed bear

sucks that this injury is keeping you out steve. as far as your driver i would think that you would only let someone that is close to you drive it, someone you trust would have a simple understanding of the situation. it makes everything so much more simple BUT i guess it doesnt hurt to cover your ***.
