Moving on.. Yes, the SOB was caught. There is a bank at the intersection where the accident happened, and an outside camera was able to catch his plate. The state police picked him up after a warrant was issued. This actually complicates things in a way, but for the best..
How you may ask? Well, my insurance company, and 2 other body shops, said the structural integrity of the vehicle has NOT been compromised. On the down side, the loss value (damages) are about equal to the cars value. My insurance company was tetter-tottering wether to total the vehicle or not, and my adjuster was VERY accommodating and was going far out of his way to help me. That being said, it is no longer my insurance companies decision. Since asshat has been caught, it now falls under his insurance liability. Because of this, I have hired an attorney. We have video, police records, the SUV in police impound, and more than enough to take this guy to the cleaners. The ITR will live again, and we will fight DAMN hard to make sure it is not totaled. It will be a legal battle with his insurance, and my insurance company is happy to help. I plan to rake his *** over the coals. As far as legal fee's, I will not have to pay anything out of pocket.
Overall, it's a sad situation, and I am really distraught over the entire thing. On the plus side, there will be a resolution, however, it may be a messy legal battle.

would it just be better to buy it back and find a shell ?
Thats if it comes down to that, i just dont see why you would want to rebuild a car that has such extensive damage.
I mean get the true value of ur car back, but me think it would be better to put the motor in a shell.

any idea why the guy left the scene?? do we know if he was drunk or high or anything? might have gotten caught too late to tell. either way ******** needs to pay.
side note, back when my interior was stolen while my car was at a shop (see sig), its obvious that I was not at fault, and the owner of the shop was liable since the car was on his property, and it was not locked or secured by a gate. anyway, since the issue went to court (I dont know if it was ever resolved in court or not) and was basically a battle between my insurance and his, rather than wait, my insurance basically decided to total the car, and then go after the other insurance company to get their money back. so they totalled it, i bought it back, and it worked out so damn well for me. my insurance gave me a good value on the car (more than I actually paid for it) because they knew they were going to get their money back. Brad do you think its an option for your insurance company to just total the car for you, let you buy it back, and then when the issue goes to court, they will get their money back? I dont know all the legalities and such, but Im under the impression thats what happened in my case. might be different in PA or something.

i guess it depends if he wants the car back for parts, or to get it back running again.
as far as a salvage title, doesnt matter. if he decided to sell it one day, he would still have to disclose the car was in an accident, probably have to show pics, etc, and that alone is enough to turn people away, salvage title or not.

If they total it, it becomes an "R" title (no pun intended) and he might not want that for the value of the car...?....financially totalling the car and buying it back may more profitable for him...but at the price of an "R" title for the R.

They have no real reason to want to total the car if Brad doesn't want them too. They should be pretty willing to pay out at least $20k (the minimum liability coverage), since a law suit is likely to cost them at least that, since they would likely have to spend that much going to court. They would likely lose and be forced to pay Brad's lawyer as well as AT LEAST paying the value of the car, etc.
So, they should be very interested in making Brad happy, at least up to $20K, probably a bit more.
