good luck bro. i hope everything works out in your way espcially because of the importwerks guy having bad intentions with the sale. whether you win or lose, you'll win in principles like someone stated earler. i understand what you're going through. i had a similar experience with an auto-parts shop too. they aren't norcal but i thought i'd share it anyways.
i ordered some parts from JDMCARBOY.com in december 2007 totalling $250. i received half of my order in a timely manner so i was very hopefully. however, i still have not received the other part of my order which totalled $150 plus taxes. it's been more than 1 year and nothing. i tried to contact them but they dont pick up their calls. they only answer my emails SOMETIMES saying that they will look into it and then NOTHING. i was pretty furious, more annimated than you because they've already been paid in full through my credit card and they still fail to send me my parts! i've contemplated taking them to court in a similar fashion as you are doing but i dont know where to start LOL. so i havent done anything, besides never to deal with them again. honestly, $150 in parts isnt worth a fight for me. i'll just cut my loses where i stand.
however, i think the state or the department that controls businesses should be held liable somewhere in the wrong-doings of these businesses. im sure a good lawyer would be able to find a liability clause somewhere because an established business goes through many appropriation processes in order to obtain privileges to operate. it's really up to people like us to point out the wrong-doings of business. im sure theres a way for us to report these kind of businesses. it's just wrong because you don't expect these things from established businesses. thats the first and main reason why they exist. they have a responsibility to their consumers. by reading all your post, im sure you already have a good argument in hand. having a good lawyer or a friend who is good with the laws is also helpful.

hey thanks for the reply. for those of you who have thought about bringing somebody to court for something you feel strong about, do not get intimidated. this was my first time filing a claim and i'm pretty new to the world if you know what i mean. it was very easy especially because the county i filed in had the option of doing it online. this was below $5000 so it is considered a small claim. in a small claim hearing, you represent yourself. lawyers are only good for advice before the court date. evidence is a must. and court fees for me so far totalled at $50.00 and no tax. anytime you file a small claim, you are given a "noob packet" that explains everything in black and white. real simple stuff. don't get intimidated. if you win the case and the guy still doesn't pay, you can hire an agency that takes any money that the person gets through their paycheck, tax returns, or any funds they receive. at the end of the day, you WILL get your money back. the agency do charge a fee but it's more of a small percentage. in my opinion that's better than not getting anything back by doing nothing.

dude i was in lodi last night at target and seen a dropped integra on some sprint harts and seen importautowerks sticker on the back glass and i giggled and my wife was like wtf and i was like u wouldnt understand..

Yikes. Good thing I went to this forum before I've had my cousin go to their shop and have his car painted. That guy really sounded like a douchebag.

nothing has been resolved before the court date. court date will not be revealed until case is resolved. i will definitely let you guys know what the judge thinks about this whole situation.

sorry to hear, that shop just sounds like its run by scammers, but anyways itll be helpful if you show this thread to your DA and they can let the judge read it, bc that guy hai or whatever the F*** seem to admit he did screw you up and was about to refund you. well good luck, wish you get your money and stuff back plus some bonus money haha

the thread about importwerkz paint quality was closed due to excessive...off topic conversations. i'm not here to bash about his company or quality of work but to inform the northern california community of my problem with a local business. please don't think i have any personal grudge against this guy. court dates have already been arranged.

what? thanks for worrying about ME getting sued but i'll be ok. i didn't make it two threads either. if you're able to get another look at the other thread, i didn't say much of anything. there is no me and whoever else either. i'm in my case alone and other people we're simply sharing experiences with the community....hopefully you're not too serious about your standpoint against what i am doing. trying to stop people from sharing their experiences with a company within a local region just doesn't sound too productive. don't expect me and any one else to just sit here with my mouth closed when given the oppurtunity to share info. with all due respect, if you don't find this thread informative or beneficial, please feel free to not participate. thanks.
