Default semi OT: anybody know about dealing with insurance companies (GA specific)?

Ok, well a link to my "I wrecked my itR" thread makes it appropriate in this forum:

https://honda-tech.com/zerothread?id=354415

Now here's my situation:

I had my car impounded by the cops after my accident, because I didn't have current tags. I got three tickets:

-striking a fixed object

-expired tag

-too fast for conditions

I had to go to the tag office, and pay $300 to get my tags current (even though I can never drive that car again). Then I had to pay $140 to the ******** impound towing company. I then called acura TLC (which it is still covered under) and have the vehicle towed to one of my nearby acura dealerships. The insurance adjuster came out like 2 days later. And although it's a dealership, some buddies of mine said there are local import scene thugs who are into jacking **** off people's rides... and people have heard that they were scoping my **** out. Great. Remember, this car has under 15k miles on it. Interior is MINT, since I kept the seats covered with sheets, etc... It hadn't seen maybe 2 days rain in it's life, and had 0 door dings. Always fully protected with a nice coat of wax, garaged, etc...

Well the adjuster said $16k in damages, and anything over $10k they usually total. It's basically declared a total loss. He also said I can buy it back for like 10% of the value of the car... Which I estimate to be like $2100...

So my buddy Dan (b18crx) helps me out with AAA and we get it flatbedded into my garage at home. Ahh, safe and sound! Amazing that guy could maneuver the car into there!

But the insurance person handling my case on the phone really tried to discourage me from buying it back. They almost made it sound like I can't buy it back due to GA laws. They offered me $21k for the car + tax, which makes it like $23k... I told them I also have about $13k in mods on the car and they said they won't be able to cover that. I told them I have receipts for everything, and they said they'll have to look at them and think about it... but that it's not likely. I told them I'd need a few days to remove my stuff off the car then...

So, who knows about GA laws then? I mean, since this is specific and each state has statutes governing salvaged vehicles. I just want to buy the car back, so I can get the motor/ tranny/ interior + all my mods... The spoon calipers and hytech header may be damaged. te37's are fucked, although they said they're covering $400/ wheel for them... The spec b's, valvetrain, cam gears, PE timing belt, and sp00n calipers are gonna be a PITA to remove... Especially since the car's tuned nice and all...

Suggestions guys?

You might have to have a license to buy a salvaged vehicle in some states. In Delaware you do, although the original owner of the car is allowed to purchase the car prior to it going to the salvage yards.

I bought my totaled 98' ITR (37k miles) back in Mar 2002 for $3800, I'll be suprised if you can get it for as little as $2100.

Oh, and I owed like $8k on it, so they took my payout ($18.5k) minus my outstanding loan (-$8k) amount minus my deducations (-$500) minus my buyback (-$3.8k) cost and gave me the body with a little cash.

There are no laws that bar buying back the car. The first time I asked they delayed until the second time I dealt with them, then they were cool with it. Might be that your insurance d00de doesn't know how to handle the paperwork and delayed.

Make sure you buy the car back -- at the very least you can sell the parts and make a profit on the buyback price.

In the future spend more $$ on track events and less on PaRTs.

(edit: added more useful info)

Ken, why dont you call another insurance company and ask them about the laws...maybe ask exactly what they are called and then go to the library and look it up, check it out. Maybe your insurance co just do not know what they are talking about. (highly possible). 10% does seem rather low to buy it back tho.

Good luck,

well, about those mods.. you didn't tell them you had them to begin with right??.. so technically they're insuring your car only.. but i know that in the 'basic' of insurance you have a limit of about 2500 on stereo equipment after which you have to declare and your premiums would go up.. i think that'll be the same case for mods.. in other words you probably won't get that money back.. in that case you'd be better off buying the car back (let's say at 3k).. then i'm sure you can sell all the chit for much more than that..

Where does it go if they total the car? To the crusher? If so.. and it's in your garage, then maybe there would be time for a Engine/Tranny swap. Of course, the rest of the mods could be swapped out as well... for maybe LS stuff... Who would know, or care... especially if they're gonna trash it anyway... yeah.. it has to have AN ENGINE and A TRANNY... but are they gonna bother to see if it's the same one that came in the car?

My insurance d00de told me they sell 'em to a wholesaler for what it's worth (buyback cost). If a wholesaler paid $3.8k for a B18C5 and got junk, I'm sure he'd follow up with da police and insurance fraud charges. Buy the car back, the world needs 1 more B18C5 Hatchcrap!
