Default bit the asphalt for the first time...get this

so tonight i ate it on the 210 freeway in pasadena california.but it wasnt my fault,yea probably everyone says that but really.listen to this.

so im riding along on the freeway,max speed i hit at one time was 84 mph,10 pm,a dude on a bike sorta rolls by me,probably doin like 100,in and out of traffic.im drivin along and i see this chp start to get into the lanes from the side and he ends up in front of me.he then put on his lights as if he were slowing down traffic,but he was just staying in my lane,usually they swerve from left to right,right to left,you know?but he just stayed in my lane.so i decided to get out of the center lane and move over.so i get over to the left lane and wow,the CHP pulls right in font of me making his driver side rear door was parallel with the front of my 05 cbr 600rr.we then collide,i blacked out.when i regained my contiousness i hear the chp officer say "dont move i have my gun aimed/drawn at you." the guy just hit me,i cant feel my body,and he tells me he has his gun aimed at me,wow.he then proceeds to handcuff me as if im a runaway murderer,like im going to get up and do something,maybe kick him with my ankle which is the size of a freakin tennis ball(no joke).so i heard him say to another(dont know who,i was busy staring at the ground so i wouldnt be shot) that i tried to run(ride) from him and i rear-ended his vehicle.thats bright,im going to run from him and see if i can go through him.ill add that i was going 20 mph as well which that chp officer said i was going 20 mph.also he states he heard my engine rev up when i was behind him,i was downshifting,which it revved higher.

dont let the chp imagine you are going to run,i guess the new technique is to hit you now.

he thought i was going to run and risk my life most of all,for maybe speeding at one time at a max of 84 mph.ill happily take the ticket.

instead of the $150 ticket,i have totalled NEW motorcycle,$10,000 in debt for that motorcycle, a hospital bill,out of work for atleast a week,a sprained ankle,the pain of the brush rubbing against my skin to clean it. yea i decided to run....please

lawsuit dont you think?

everyone be carefull please

if the story sounds all messed,my bad,i was put on morphine and vacadin(however its spelled)

It sounds like a case of mistaken identity. The cop may have thought you were the guy who was weaving in and out of traffic and speeding. Either that or they clocked you when you were doing 84 and they were actually trying to pull you over for speeding.

I hate to tell you, but the burden of proof is going to be on you. I had the same thing happen to me when I was bringing my f3 home in my truck. ***** in a pickup was weaving in and out of traffic and damn near ran me off the road. He gets in front of me and a cop clocks him, he keeps driving fast and the cop pulls me and says that 'your buddy got lucky that he got away'. I explained to him that I had no clue who the other guy was and he almost ran me off the road. The cop didn't want to hear it. He gave me a ticket for 15mph over the limit.

I had my truck on cruise control but it didnt matter. My little 4 cyl s-10 pickup will barely get over the speed limit without a 400lb motorcycle in the back....

Ah well, glad you made it out relatively ok. Good luck with the whole thing.

Man, sorry to hear that about that spill and the bike. I thought for a second you were just in his blind spot, but hell no ... I hope that's not the new HP technique. Anyway, best of luck with the recovery and the $ recovery.

Holy crap, my first thought is lawsuit, but I think cbrman is right. "I hate to tell you, but the burden of proof is going to be on you." I think the court is going to beleive the cop more than you, especially since you have been labled as a dangerous reckless sportbike punk (from the guy that passed you). Damn dude that sucks. But they would not have any solid proof it was you either, I guess it's their word against yours. Good luck man

One time I was cruising on the highway w/a passenger in the middle lane doing about 76mph. I signaled to go to the right(slow) lane and a highway patrol comes speeding up in the slow lane so I turn off my signal light and stayed in lane. He comes up real close and then merges half way into my lane, then turns on his lights. I proceeded to pull over right away. He was just yelling saying don't ever try to run because if you did I would have hit you. I guess that is the reason why he pulled so close and at an angle. He also proceeded to say that they have cameras installed and that it was good thing I pulled over right away. So, this must be the reason why so many riders have bent plates. He ended up letting me go.

Be careful out there, they get a real kick when they go after bikers especially the ones that like to run.

Removing your service pistol from its holster is an act of force, much like using your car as an impact tool. One could probably argue that both instances of force used in this situation were excessive, thus the actions taken by the officer were negligent.

Both of these actions must be followed up with the proper use of force report, which can be subpoenaed by the courts. At this point, they are open for examination.

Contact a lawyer and file a claim with the municipality where the incident occurred. Be sure to try and find a lawyer who has some type of experience in this field, as there is a legitimate amount of damages that could be awarded.

Good luck, and I'm sorry to hear about your situation.

thanks alot guys for all the info.i do not think they have any evidence on me going 84 because the cop i saw on the side was helping out a stopped car with a tow truck,plus,there were many cars between me and the officer that could have clocked me.

Yeah, this is the main reason I fled the People's Republic of California. Six years in my car and on my bicycle and nary a point on my license and then I got the 'crotch rocket' and I'm staring at losing my 'privileges' within a year. Sure...they don't discriminate/profile.

Anyways, get a lawyer if you can because I never saw anyone win a thing in front of a judge without a lawyer...including me. Even though I won everyone else in the room over, including the other officers there for their cases, I still lost. I go in for speeding and beat that but the judge arbitrarily tacks on wreckless driving and fines me for that. What a load of crap.

Anyways, the lawyer is going to have to subpeona the video from that squad car so you and he can review it. They usually turn on whenever the lights are engaged so it's a load of crap if they tell you they don't have it. The camera is usually facing forward but you should be able to tell if CHP was swerving/changing lanes when the collision happened. That would throw the burden back onto CHP since it would have been the cop's action which caused the impact...most likely.

Never heard of any instance wherein a trooper was given the ok to take out a biker with a patrol car. That's just wreckless.

yea thats how they chp do it in california, they try to run you off the freeway because so many bikes will run from the cops and get away, but its another thing to hit you off.

Sorry to hear about the accident, I agree with everyone. Get a lawyer and get all the evidence that you can. The more things I hear about CHP, I am glad I don't live there. Hope a lawyer can help you out and you win your case. I can't believe that he just hit you like that. Good lucK!!

Wow, this incident sucks! Sorry to hear your loss. Did you have full coverage on the bike? For the cop having a mistaken identity, you were doing 84 so kind of hurts you in a way. Wow, I'm on the 210 every weekend. Definitely get a lawyer, because that was unncessary force.

i only have liability,but i got this insurance kind of thing when i bought my bike.if the bike is stolen or totalled,they give me $5000,so thats a little better.

i spoke to a lawyer.i need to get a copy of the police report.yea,the lawyer also told me to make those medical bills go up.

the lawyer said i have a pretty good case but my injuries arent bad enough...ohhh my neck just started to hurt..haha

How is it that your out a 10k motorcycle? Don't you have insurance?

You say the CHP officer hit you with his car? I surely hope you aren't giving us some BS line to save your ***.....

With that said, IF the officer DID do exactly as you say, and you can get 1 witness to verify what happened to you, you are about to get a LOT of money from the state and you are going to place 1 CHP officer on permenant leave from the department.

What the officer did was reckless endangerment. Not only to YOUR life, but the LIVES of other motorists on the road. This is NOT the proper way to pull over a motorist and is NOT taught to ANY officer on the road. This technic is ONLY done to other CARS as a last ditch effort to get the driver off the road. Even then, it was done improperly if you described it correctly.

I know you don't know me and I don't know you. So I'm taking your story with a grain of salt, but if I was YOU and the story I told was for real, I would be talking to the NEWS and trying to get ANY person that may have been on the road at the same time and one that CLEARLY witnessed the incident. Then I would contact a NUMBER of lawyers (mainly ones that LIKE to sue the crap out of the police, and ones that have a track record of winning) and get them onboard "PRO-BONO" until the case is WON.....

WHICH, again, if this story is acurate, you will WIN.

But in the state of california, you are "required" to carry the minimum insurance if you "own" the bike, and if you're financing it, there are larger "minimums" you need to carry, mainly comp and collision

yea i have that pro-guard one,also works if it is totalled,i hope.also have liabilty,not full coverage.

the story is accurate,no lies in there.

ironically,my girlfriends brother was on the same freeway,saw me getting handcuffed and all,but i do not know if he saw the accident.

ill see what i can do about witnesses.thanks yall
