Default what would u do?

i was at the just got to the gym. 15 minutes later, i hear over the intercom that somebody has backed up into my car. I went outside and this old lady driving an ford f150 came over and told me she could not see my car due to a blind spot. She told me not to call the cops b/c they not gonna do anything. She was gonna get my car fixed. At first I was like, OK. I called my wife up and she told me ta call the cops, so i did. The lady was offering to give me a check for $300 right there. and fix the car(she knows people at the junkyard). I just waited for the cops. 30 minutes later, the cop pulled up and gave us a police report and told me i could either have her pay for it or leave it to the insurance company. When i got home, i called her insurance company, they took all of our info and told me the claims department will call me up with an answer will be calling me in 2 business days. I called them back 2 days later and they told me that they could not do anything b/c the other person has cancelled her insurance. I was like WTF!! Now they can't do anything. What would you guys do if this happened to u??

Talk with your insurance.

You have uninsured motorist coverage, right? You should, and if so, your insurance will cover it and sue her personally for the costs.

1) Inform the police (try to get the officer that did the report) that her insurance is non existant, thats illegal in most states. Ask them what your current options are.

2)get several quotes to fix the car and contact her and demand immediate payment, no excuses, like Your on the way to get the check. however if she isnt paying for insurance she proly doesnt have money so it'll be a bad check. Which is also illegal, again let the police know she did that.

3)start the litigation process. The gov't is extremely slow so it takes a while

4) win your case in small claims court and still have no way to collect the money, because if she doesnt pay you cant do anything.
