Icon2 CEL in cold weather somehow linked to brakes

Hello.
I have some strange problem started to happen 3 days ago with my Honda Prelude 2000
80.000 km
It looks like that:
I start my car in the morning (temperature <10C) - no CEL
I press brake pedal for the first time - CEL comes on
Start to drive, stopping accelerating, CEL stays on
5 min later CEL does off
Every time I press brake pedal after 5 min CEL goes on and off again when brake is released.
This is happening until the car is fully warm.

Not reproducable during the day or evening - I guess it's not cold enough.
Today is warmer weather - no issue in the morning as well.

Went to Honda dealer(day time) - they couldn't reproduce the problem, the computer didn't keep the morning code - they didn't have any ideas, but charged me $75

Please help me to understand the issue.

I am doing some checking on this, It has to be some kind of electrical back feed. I am just trying to find out how the brake lights or shift interlock tie into the powertrain management.
