Default Nissan dealer problem..Help and need some Optinions on this..PLEASE!

Hello, I drive the Accord, my uncle drives the 04 350Z.

My uncle traded in the car he previousily had which was a black 02 Hyundai Tiburon GT (valued at $ 9,500 <-- low huh?) and he bought the 350Z with no problem. He had V1 detector power-cord(you guys with V1 detector should know what I am talking about, it's $30) hooked up to the fuse box with Aligator clips cliped to one of the power sorces, and under the plastic parts(the part there the tec-meters usually hang(left?), can't think straight right now) and just gently pushed in between sealing foam and the front windshield rubber. I was there, so here is the converstation that I can remember.

This was around 04 March.

---------------------------------------------------
Uncle: "I have my power cord in the car(Tiburon) still, should I take it out right now or would you guys do it?"

The Technician and Dealer: "We'll take it out and have it ready for you to pick up. We'll give you a call when the cord is ready to be picked up."

Uncle: "Do you guys know how to take it out?"

The Technician and Dealer: they look it up real quick..and seem to have no clue, and returns with the question. "How did you install the cord?"

Uncle: "I simply pushed in the cords into the rubber, and for the side, I took the part off by (shows how).. Can you guys do it?"

The Technician and Dealer: "Oh yeah, that seem easy enough, we'll give you a notive when you can pick it up after we take it out."

Uncle: "Ok, sure thing, thank you guys."
---I didn't say much in their converstation, part of dealing I guess---
---------------------------------------------------

It's been good 3 month since the 350z has been with my Uncle, and the dealer decides not to give us a call back, and so I loose my patience with the dealer, so my uncle asks me to call the dealer with his information( I called because I speak better english better then he, no other reason ).

---------------------------------------------------
Me: "Hi, I am "My uncle," and I traded in Black Hyundai Tuburon for white 350Z about 3 month ago, And I have asked you guys to take a cord out of my traded in car, is "Dealer" there?"

Front Desk Lady: "the "Dealer" is in a meeting at the moment, Can I take a message?"

Me: "Yes please. My name is "My Uncle's name" and the phone number is 303-000-0000, If you could have "dealer" call me back when "dealer" is done, I would appreciate it."

Front Desk Lady: "Ok, thank you for calling." BEEP
---------------------------------------------------

So we wait, watching "How High" and "Scary Movie 3" <-- addes up to about 5 hours including lunch and all...
I reviece a call from the "dealer"

---------------------------------------------------
Dealer: "Hello? "My Uncle"?"

Me: "Yes this is him,"

Dealer: "Sorry, I was in a meeting for long time and was very busy. And for the power cord, I am sorry but "The Technician" coundn't take the power-cord for your detector with out taking things apart, and it would have costed us over $100 in labor. And that's all I know, don't know much more about it."

Me: -I pause for while b/c it is complete bilge(nonsence) to me what-so-ever- "well, I asked "The Technician" if he knows how to, and I even showed him how-to, and now your telling me it couldn't be done? I taught I had "The Technician's" and your word on the power-cord being out and ready for me to pick up."

Dealer: "I am very sorry, Would you like to speak to my menager about it?"

Me: "If you could do anything about it, yes please." -I got put on a hold for over 5 mins-

Dealer: "I am sorry, my menager won't do anything about it."

Me: "well...OK, then is the car still there so that "I" myself could take it out?"

Dealer: "No, and sorry agian but the car was sold 3 weeks ago."

Me: -BIG pause this time, and yet for another complete bigle...- "What?"

Dealer: "yeah, I am very sorry, but "The Technician" couldn't do it with out spending over $100 on it for us to take the power-cord out for you."

Me: -another pause- "well, ok then, can I ask you a favor? I am not sure if it could be done. Could you contact the customers that baught the car and ask them to take the cord out? and bring back the cord to you guys some how? I'll pay for what ever cost they ask and some labor charge for you guys. Is it possible?"

Dealer: "Yes I sure can try to contact the customers of the Tiburon. I'll give you a call back within a week, is that ok with you?"

Me: "yes, Thank you." -BEEP
---------------------------------------------------

My uncle and I discuss wtf is going on, and he is now really pissed off, and we just decide to take a ride on the Z, stress freeing ride of speeding about at 95 with the detector(the detector includes two types of power-cord. One curly-springy one, and one my uncle used in the Tiburon)....

Today, I called them back, it's been over a week, no call back. I calm down first and called...

---------------------------------------------------
Me: "Hi, (same intro as I called all the time)"

Front Desk LAdy: "yes, hold on a moment"
-got on a hold for about 5 mins-
Dealer's next desk Lady: "the "dealer" is out on the show room, can I take a message for her?"

Me: "yes please, My name is "My Uncle" and phone number is 303-000-0000, Just have her call back when she has time to call back please. Thank you" -BEEP-
---------------------------------------------------

At this time of point, just trying to calm down..but can't stop thinking about it...little bit of game...and a phone rang from "the dealer"

---------------------------------------------------
Dealer: "Hi, I am sorry, the customers would not answer my phone call. I am very sorry."

Me: "um, ok. I am sure I asked if it could be done, and I had your words, and now you are telling me it couldn't be done. I see. -bit of a pause- The power-cord is about $30, and so, I know this is complecated, Can I have anykind of a refund or return of a service for that?"

Dealer: -She too pauses for moment- "I need to talk to my menager about this one, I'll call you back when I get the answer, OK?"

Me: "sure, Bye"
---------------------------------------------------

I go to rest-room, and my uncle doesn't bathers to answer the phone b/c it was her ## on the phone. And the menager called back with lot of a hostile..can't exactly understand him because the "manager" is in a "hostile" mode on the phone while leaving a message. But I clearly understood this.

---------------------------------------------------
The Manager: "Hey Listen Kwon(My uncle's name is NOT kwon, don't know where he got it from), you are just out of luck with this power-cord you want, and stop giving the "dealer" hard time about this. And I WILL NOT refund or anything for this cord. It is clearly your problem now, please call me back if you have any questions, my number is 303-000-0000 (the menager decides to give me his dealer number instead of his desk number, I couldn't even understand his name when he introduced himself. ok.. )"

Here I am after taking a long stress-freeing drive with my uncle in the Z.

Who is right at this point?? what should I do with this?? **I do not want to call them back saying I want a refund, and it's almost impossible to get some kind of refund back from the dealer at this point.**

Thank you all for reading my long LONG conversation.

P.S. I will post up the voice-message he left in MP3 format for yall to hear, but how ever I'll have to block off some numbers and names on it, don't want a big trouble.

Honestly youre screwed...unless you have any WRITTEN proof that they were supposed to remove the wiring, the phone message is the only thing you have. But I have an idea.

1) Forget that dealership. Tell them you want to speak with THEIR boss. Bring along your mp3. Even if you don't get your cord back, with the way he treated you, he'll have some words given to him. Which is a reward in itself, and may lead to your benefit. After the 'higher authorities' are through being pissed, they might try to make you feel better with a refund.

2) If this doesnt work, take it to Nissan itself, file a complaint against the dealership to the parent company. It might not do much but it'll be a thorn in their side that they didnt have before if Nissan itself starts bitching.

3) Take it to small claims court. You might lose, but threatening to go to court over it might take some of the wind out of their sails. They'll think twice about it.

4) Your uncle should have just taken the damned thing out himself and saved the hassle. Mechanics love making money pretending that what they do is very hard. Counter this by giving them the royal FU and doing the work yourself.

5) they should treat you a hell of a lot nicer if you got 2 cars through them. 30 bucks is small change in terms of the cars.

I hope that sort of helped. I've been treated like **** before in several places (dealership and car audio store). It sometimes gets you nowhere but think of all the time and effort they wasted dealing with you

Dont mean to be an *** or anything... but your uncle just bought a 350z which are about $30,000 if my memory serves me right... and your stressing yourself out over $30! dude just order another powercord.... i know its the whole principle of the issue that problably has your more upset, but its not worth the stress... you should file a complaint with nissan, or show up there and get loud with the sales guy, make a big commotion, they can say whatever they want over the phone, but its a different story when you are in person. goodluck man.
