For those not aware of my first incident with the competition in the JDM engine industry, here is the link.

After posting the thread I received a physical cease notice from Osaka and Nagano, while they are the ones posting bogus threads about my company. Not only did that letter demonstrate how selfish these companies are, but also how they are associated with one another- despite all the accusations which they denied. I posted the events as they happened a few months ago, and now they are back.


Part II
Sunday, March 14th, the eve of my birthday I was in charge of responding to email inquiries and I receive a threatening email. Here it is. (I did not censor the foul language, please be advised)

hey bitch you think your number one in the motor business. really u aint
****. ur just a little piece of **** that everyone steps on. ur business
sucks just as much as u suck dick. **** total jdm. if i see u im gonna kick
ur little total jdm ****** ***. if i see ur business im gonna burn it down
with u in it. u think u will get more business then me but really u aint
****, everytime u sell a motor i sell 10. ur nothin accept a litle piece of
****. just do us all a favor and close ur little shitty shop down. save
urself the enbaresment u ***** *** total jdm bitch. and dont think cause u

At first I simply assumed it was someone trying to ruin their name because they actually employed "JDM STAR" in their email address, and it's from Hotmail. But then, I receive 3 phone calls, and 2 people who cancelled their orders after reading comments made by "one of our customers". I thought to myself, here we go again... only this time it officially cost us 2 paying customers, which we hope they will feel comfortable in doing business with us again after this matter is cleared up.

I log into Honda-Tech and surprise, those familiar posts with false claims are back! I contacted the HT mods to receive as much information as I can, in order to deduct who the culprit vendor is. I started my own little investigation with "JDM STAR", and my investigation did not need to go any further.

In the threatening email I was able to get the sender's
IP address. Here it is.

X-Originating-IP: [206.149.156.159]

I decided to email them, and in the response I would verify whether the IP originated from the same people who threatened me. In fact, it did. My investigation was going very well.

Received: from 66-pool1.ras12.vaash.alerondial.net ([206.149.156.66] helo=japan1)

Now, I understand the last 3 digit numeral does not match, but to my knowledge, this is caused by sharing a connection, with the use of a router. I also traced the threatening message with the aid of NeoTrace and it led the user to be in VA, where JDM STAR is also located.

Their website is http://www.japanstarmotor.com/ and it oddly resembles the Nagano website, which was also targeting to give my company a bad image only a few months ago. Their website is http://www.naganojapanese.com/ Both sites even have the same webmaster.

I'm not sure WHY these companies try to pull these types of stunts. I have nothing but respect for companies such as PasswordJDM and HMotorsOnline, they do their own thing, have alot of satisfied customers and live up to their word. They concentrate on their own business, with years of experience, they earn the trust and sales from their customers, not libel/slander other companies with bogus stories. This is totally absurd, never would I attack another company, never. And the worse part is we struggled to make it in this industry, and we would never leave a customer unhappy with his purchase, and these people claim to have been ripped off, and alot of people are quick to believe the person with 1 post.

Again, I am sharing this event with HT members so they can all be made aware of the type of service and business ethics being practiced by several of my competitors. Notice I used the word "competitors", why do they assume they are my "enemy", I have no will to injure or terminate them, I would simply appreciate if they could mind their own business, and run their legitimately.

I will wait and see what their defence is at this point and will speak to my legal representatives. If anyone is interested at this point I can offer brief updates as they occur.

damn, their websites are the same. that's kinda scary when you think about it. it's sad that you're losing customers because another company is jealous and wishes they had the business and reputation that you have built.

That's pretty funny, after all the BS business I have read about coming from those guys, they still have the nerve to do **** like sned emails of that sort. I guess they are desperate, because they certainly aren't smart.

Andre,

This is interesting and if they are indeed posting fake messages of bad sales experiences with you in order to discredit your business then you may have some recourse. This is especially true if they're in Montreal. Libel as it's called is known as a reverse onus offense. In other words if they make a statement ("I bought a motor from XXX and it was stolen") or whatever then they have to prove that what they said was true or that they made reasonable efforts to ensure it was.

Barring that you may have a fairly good case to sue. You could sue for the loss of reputation, loss of sales etc. I'm unsure as to the exact limitations in Quebec as their civil law is slightly different than ours but I suggest speaking with a lawyer. You certainly would't see punitive damages awarded like they do in the USA, but it's definitely worthwhile to do something about it.

If you can find indisputable proof that the people are associated with japan star and nagano, then sue them. You have proof that their slander has caused a direct loss in customers, so show them who isnt worth **** and shut them down !

i agree with the lawsuit.. i hate people like that, who cant earn there reputation, but have to try and 'steal' it by hurting someone elses. After reading all the threads and seeing your professionalism (is that a word?) my new motor will be coming from you, might be a while because i am poor right now, but it will def. be from you. Good luck, and keep us updated, hopefully if you sue they wont be your competitors anymore, but just another person on the street, who lost their business and hates the decisions that they had made. again good luck and hope to see all fo this end soon.

slander is spoken word.
this would be a case of libel, but probably more of a defamatory action b/c libel is usually for more public audiences. if he posted it on a website or message board it may not hold the same validity. they are affecting your reputation which is directly related to the libel laws of this country, but what they are saying cannot be true.....meaning..... if they could get customers of yours to admit that you're a ****** it could be tough to argue.

suing them seems good now, but in all reality the thought of suing someone is more appealing than the actual process.

It's so sad to see a good companies name trashed like this. A large group of my friends did a group buy on motors throught Andre and bought like 10+ motors. Every motors was in extremely good condition and the service was even better. If I ever need another motor I will not hesitate to go see Andre.

Contact a lawyer.
I know here in the states it's defamation of character/slander. If you can prove that it's hurt your business you have a case.
Like you stated before, don't sink to their level. Keep all this stuff print it out.
Do some research to get conclusive evidence that it is who you claim it is.
If it really is who you claim it is (which I do believe you) thats very immature and pathetic of them to try to ruin somebody's reputation because of their own short comings.
I can understand your frustration. It pisses me off just reading this stuff. You have to be very carefull about who you deal with these days..
By keeping your head on your shoulders it just proves that your the better person. And in the end the bigger person will come out on top.
Not sure about you, but if I were in your shoes and this was happening to me I'd be very mad. It's fine if you want to mess with me, I can handle that, but messing with my family and ultimatly effecting my life..you don't want to do. If I lost my business or lost a large amount of revinue due to someone elses false claims i would persue justic by every means possible.
