Friend just got into an accident and needs some help
My friend with a RSX was rear ended today by some lady driving a super bucket with NO insurance. His back bumper is fucked including his magnaflow exhaust. The exhaust pipes are out of line and and bent/push back into the cat. He doesnt have the receipt for the exhaust, although I can probably get him one.
The thing is that the police said they wont file a police report because no one was hurt. Also the lady has no insurance, so is my friend suppose to sue her for damages to the car because it seems unfair to me if he has to deal with his own insurance comp about it.

when i got into an accident a while back i had the same problem with the cops, they wouldnt file a report. luckily everyone had insurance in my case though. but yea i think you're going to have to go through insurance to get the car fixed first, then you can go out and sue the crap out of the lady with no insurance

I believe he can take her to small claims court if shes not willing to pay for the damages and was clearly her fault. The police should've at least made up a report to say how it'd happend.

ca dmv vehicle code says a report is required if damage exceeds $750 for either party or there is an injury.

damage must be minimal. he should use the insurance he pays for... fault will undoubtedly be 100% for the person that rear-ended him.

Cali is kinda *** backwards. They fine our *** for car mods but wont file accident reports??? Wish I could help but around here police do accident reports no matter what, so that who ever is at fault has to pay the damage cost or go to court and fight and have witnesses that thye were not at fault. Sue her *** if she doesnt want to pay, or get his insurance to fix it and then see if they will go after her for reimbursement..

give her an option to pay or through an insurance. why wouldn't chp file a report? i suggest nottouching your insurance policy. seen to many premiums go up. at least get an estimate. good luck

exactly what I thought Cali laws were like, but only a citation was notice.
I still dont like the fact that no police report was made, although this happened locally on the streets. Funny thing is... the POLICE STATION WAS 1 BLOCK AWAY and yet they still didnt come.
Insurance told my friend they wont cover his aftermarket exhaust which pipes were bent, so we found a shop that would help us order a greddy exhaust instead of the oem one for my friend.
