Can some one here give me some info on my case, I greatly appreciate that...Thank you in advance...

Here's my case:

I recently drove my car to work (menlo park) and parked in the company's parking lot. Around lunch time, I went to my car (98 Accord) and found that there's a scratch on the rear driver side bumper. It seemed to me that someone when s/he pulled the car into the parking space right next to me got too close and his/her bumper scratched my bumper. My bumper also has some white powder left on the scratch. So I looked at the car that parked right next to me, looked at the passenger side front bumper corner and also found a small scratch on the corner w/ the same white powder. SO it's gotta be that car who scratched my bumper!!!! I quickly grab a camera and took some pictures on both cars. I also notified my security office and they helped me locate the owner of that other vehicle. That owner, let me call him 'person A', quickly denied that he did it. He said that he didn't feel that he scratched my car when he pulled in the lot. I pointed to him about the scratch and white powder I found on his bumper which also matched the powder on my rear bumper. but he kept on denying. He insist that he would rather go through insurance because he didn't do that. So I called my insurance company and told them what happened to my car (I also gave them all the info about the other party). And now, I just received a form from my insurance company which I have to fill in (accident report form) and send to DMV. It's not my fault and y do I have to submit this form to the DMV and runi my driving record? plus the accident report form states that I only have to report to DMV if there's injury or damage > $500. To repaint my bumper will not cost more than $500. So I don't think i have to submit the form to the DMV, am I right on this? On the other hand, how can I win this case? since this is not my fault, and it's pretty clear to me that 'person A' caused this accident, and I have to pictures to prove the scratches and white powder found on both cars. I really want the other party to pay for the repair of my vehicle, even if my insurance cannot get the other party pay for the repair, I am assuming my insurance will pay for me to get the car fix up. All I want is, get my car fixed without my paying anything off my pocket, my insurance premium will not go up, and my driving record will not be affected? What should I do guys? Please help...

did you ask your insurance company why you have to submit forms to the DMV? they'd know more about that kind of stuff than anyone on this board, IMO...

get a quote on the paint job, then take it out on his face and/or car, then deny it, worked for him......
