Look at this bullcrap....
i sold my konig rated-r's to this guy 'bout a week ago. He just got them today and sent me this email:
"the rims showed up today, they are on their way back friday, you said they were in great condition which they arent, you also wrote the tires are in good condition which are bald down to the threads except for one tire, you can send a full refund to my paypal account or you can expect my brother in law which is a cop in your local area to give you a visit monday."
I lost the emails i had sent him before but basically i told him that the rims were in great condition and the tires were in good condition. The rear right rim has a curb mark that only got through the paint (didn't damage the rim at all)...the rest only had natural scratches. The tires were in good condition...NOT GREAT...good condition. The edges of 3 were bald like he said, but that's cuz the guy i bought the tires from had major camber issues. The center on those three had ALOT of tread left...so unless he has major camber issues, he shoud be fine. The fourth tire was almost new.
What I think:
1) he doesn't have brother in law here that's a cop
2) he blew up the words 'great' and 'good' to mean PERFECT
3) if he sends them back, he aint' getting a refund cuz i'm not a store. i'm a personal seller
4) he can't demand a refund
5) IF he has a cop show up at my front door on Monday, i'll sue him for false accusations...then i'll get the wheels + lots of cash!!!
Other opinions?

That sucks. I don't think that you have to refund his money, but paypal might throw a fit. As long as you were honest I wouldn't sweat it all. He can't expect a set of USED wheels to be perfect. Good luck man, I hope everything works out.

did you send him pics before he paid? i know i personally wouldn't buy something like rims without seeing them so that i could have proof. Good luck.

I ddin't tell him all sales final, but like i said, i'm not a store. with personal sales, it's already implied that everything is sold as is and not returnable...unless i'm feeling really really really nice...which i'm not
and he couldnt' ahve expected brand new rims. These things were up on on Ebay (but he bought outside)...pictures and all.

You know, i probably WOULD give him a refund (except for shipping) except that i don't have the money. I spent it to get a transmission. That's why i sold the rims in the first place.

You know what? Just tell him he bought them and now they're his. You don't have to return his money, he can do whatever he wants with the rims now.
If he wants to ship them back to you, then fine. Hold onto them. If he decides he wants them back, have him pay for the return shipping AGAIN.
Anytime you do a personal sale like this, it is always implied that everything is sold AS-IS, even if it isn't written as so. It isn't even a large scale item like a car, they're rims!
Tell him to go screw himself and have the cop come to your house if that will even happen. The cop can't do anything.
Keep the money.

Yeah don't worry about it, man.
Don't take what I said literally, don't say "Go screw yourself."
Be somewhat civil about it, but tell him straight up that you sold him the rims and it's not your problem if he isn't happy with them. They are now his rims and whatever he decides to do with them is his decision (even if they are to send them back to you).
At this point, the only thing he can do is argue with Paypal, which most likely won't get him anywhere. But just in case, take out the money from the account.
OR....he can actually go to a lawyer and bring up a claim against you. Now this almost 100% won't happen because being that they're only rims, the cost of having a lawyer draw up a claim will cost him too much money and time to go through with it. It wouldn't be worth it at all for him.
Don't sweat it....you got your money......and maybe a set of rims

Yeah...i never name called him or even cussed in the reply email. But i did tell him that if he sent them back, i'm keeping them w/ no refund. And i KNOW he aint' getting a lawyer...before he bought the rims, he had to check if he had enough in his account to buy them. So he defintiely doesn' thave enough for a laweyer. I kinda hope he sends the wheels back cuz i'm rolling on steelies right now

the dude is being an ***, okay.
that being said, he will continue being an *** until he gets his way or dies. and I can't imagine that happening anytime soon (don't get any ideas
)
you need to make sure you are calm and don't write any "poison pen" letters to him that would instigate things more. obviously he's pissed...let him cool for a while, and be calm when you write, with a calm tone.
if you decide to drop the bomb that you can't refund the money because it isn't there, you'll have to stick with that. I wouldn't tell him your situation because it makes you more vulnerable.
if his "brother" comes over, take him to the cleaners via the local police office for harassment.

make sure to save your shipping documents, just incase he complains to paypal. all paypal cares is that you ship the the items. so all you need is tracking # for all paypal care you shipped him a brick and they won't investigate the claims anyfurther. well i would not recomend shipping bricks.

I would not do a refund at all if the pictures you posted on E-bay matched the rims you sold. If he knew what he was buying and saw the pictures then you are in the clear.
If the cop comes to your house, start to laugh at him and close the door on his face

His latest email:
"You did not state that sales are final anywhere in your ad"
My reply:
"Sales being final is implied when buying from a personal seller
I suggest you stick those wheels on your car, stand back a few feet, and you will be happy with the way they look"
In regards to his reply...not only are final sales implied when buying from a personal seller, but my 'ad' was on EBAY...and he bought OUTSIDE of ebay...

If the buyer charged it on his credit card.. trust me you're screwed. He CAN get his money back. I had this guy buy a printer from me and in the auction I stated NO accessories and he implied the toner and misc stuff was included. He filed a chargeback and I was out of 50 bucks. But oh well live and learn.

True, what the hell can he do. If he's not in his local jurisdiction you can do that. Regular police officers don't handle crap like this anyway. He is probably a stupid kid trying to scare you "oh yeaa, well my brother is a cop and you're in big trouble"

He got what he saw on ebay. I didn't exclude anything that i said i'd give him. End of Story. It sounds like he's realizing there's nothing he can do about it by the tone of his last email.
