Default Race car bill of sale

Anyone have one ?

The only one i found has these as the terms:
"In connection with the described vehicle, seller expressly disclaims all warranties, either express or implied, including, but not limited to, any implied warranty of merchantability or fitness for a particular purpose.

Seller neither assumes nor authorizes any other person to assume for seller any liability in connection with the sale of the described vehicle.

and i dont see taht working for a racing car

Anyone have one tehy could post or email to me ?

Put money in bank. Destroy any evidence linking you to the car...

In all seriousness, unless the buyer demands a bill of sale or you have the car registered or something and have to prove to your municiple bureaucrats that you don't own it anymore, I wonder if it is more liability exposure than anything.

The nature of legalese is that, in attempting to indemnify yourself, you have to use specific language. That language may or may not be all-inclusive so, if you wash your hands of any injury or death that might occur on the track, you may by implication take on the liability if the thing catches fire in the buyer's garage.

I understand that BUT

Legally if I didnt state the conditions of the sale I am liable for EVERYTHING that could occur until such point in time that I had alienated myself from such a possibility.

Basically if i dont say I am not liable.. I am under GA law

Here is what i use. I basically made it up for both street and racecars and adjust it slightly depending on need. I then have the buyer and seller each sign it with a witness and each person gets a signed copy:

BILL OF SALE

This receipt acknowledges payment in full of $XXXX for a 199X XXXX, VIN XXXX. The car is being sold by XXXX to XXXX. The odometer reads XXXX miles and is known to be correct (or incorrect). The car is sold as a racing car with no guarantees or warranties expressed or implied. XXXX takes ownership and possession of the above listed car on XXXX.

Hope this helps, feel free to use partially, completely, or not at all.

Don't get specific, because as others have stated, specifically stating no liability for one possible outcome implies liability for all others.

Just use a very brief, "no warranties or guarantees expressed or implied" statement to get the point across. Any further embellishment could end up shooting you in the foot if you find yourself in court with some sleazy lawyer questioning you about what you thought you said in legal-speak then explaining to you what you actually said under the word of the law.

Sometimes less is more when it comes to stuff like this.

I disagree in the highest sense.. I think by not specifying it is as if you claim ALL responsibility.

Because if it doesnt say you dont.Then you do!
Just like if it doesn say you can. YOU CANT

What about the standard line a number of organizations and such put up. "racing is a dangerous sport....you could get killed, mamed, harmed and probably loose all yoru money. Participating in racing is done at your own risk."

Something like that, anyway.

This is not legal advice and should not be construed as such. I agree that stating you are not liable for activities X, Y, and Z sounds like it could leave you open re: Q.

K.I.S.S. Disclaim "all" liabilities, "all" risks, "all" warranties, and "all" guarantees, be they known or unknown, express or implied. I would also add something to the extent that they buyer and seller agree that the vehicle is not fit for ordinary road-going purposes and is sold for off-road recreational use only.
