Damage to hatch - What should I do?
I got hit from behind by a truck. My body shop wrote me an estimate for about $4,000. I have liability insurance only. The truck's insurance sent over an appraiser and want to send a settlement check for $2,600. I need to sign a release first which reads as follows (modified)
1. release and forever discharge insurance co
2. agree not to make any claim or take proceeding against any person or corporation who might claim contribution or idemnity under provisions of any statute or otherwise;
3. agree that the said payment does not constitute an admission of liability on the part of the release: and
4. declare that the terms of this settlement are fully understood, that the amount stated herein is the sole consideration of this release and that such amount is accepted voluntarily as a full and final settlement of the claim for damages specified above.
Shouldn't I be entitled to full cost of repair. Please help

That's what I would do. $2600 is more than enough to get your hatch replaced and just use the rest towards other things on your car.

take the $2600 and go to a junk yard and buy another hatch for like $250-$300 . take off your old hatch and install the new one . do all of the labor yourself , thats where the body shop likes to charge . then go to a bodyshop and have them paint it for like another $250-$300 . then you would have around $2k left to do whatever you want with
how your bodyshop quote you that much when it looks to be replace a rear-hatch and maybe the bumper? is there a body frame damage?

Call the insurance company and tell them that you went to a bodyshop and had it appraised and that you can send them the estimate, and tell them that if they can tell you which body shop will fix it for the price that they quoted you at that you will go there.
dude get a lawyer. 2600 and they want you to sign a release? tell them you want damages fully paid for. that release seems like they wanna trap you. get a lawyer.

You might not want to get a lawyer so fast as they'll take a big chunk of the check and you might end up less than 2600$ in the end.
Demand for more or you'll sue for body damage since your neck started to hurt and you have sharp pain on the side of your head while your right eye lid jumps.
Ask for 3500$ and you'll sign it immediately or they're going to have to pay for your lawyer fee, they will have to pay for your medical (pills, doctor, chiropractor) PLUS fixing your car

If you dont fix it yourself take it to another bodyshop and get another estimate. If it is the same then have the bodyshop contact the guys insurance company. They usually work deals out and the insurance company <U>HAS</U> to pay for the full damage removal. NEVER sign a release until your car is completely fixed and paid for.

I have an entire rear hatch assembly from a '95 GSR. Its milano red and in perfect condition. You could have it painted and installed and pocket the rest of the insurance money.

I'd go that route, then find another hatch get it repainted and use the rest for any thing you want

Am I suppose to talk to the insurance company or the adjuster. It took me 2 months for them to finally settle. The insurance adjuster wrote me the letter. I'm in no rush so I'm going take my time.
