Insurance Company help...
Ok so as some of you all know I wrecked the teggy
Well anyway I don't think my insurance company is going to give me very much money for my car. Does anyone know of any insurance law that saws that they must replace your car? I think that they normaly give you a check for it but I would rather they replace my car, is there any way to legally make them replace it? I need some help on this one so if you know anything about this or know who I could speak to I would really appreciate the help. Thanks!

From what I understand they give you a check for current market value of your car so you can replace it. Plus you have the option to buy the car back from the insurance company. Basically if current market value is $15000 and buy back is $5000 then of course you know what your check would be if you opted to buy back. At least this is the way Allstate Insurance is in North Dakota.
if your policy says "actual cash value" then you will be able to get all your car was really worth. i'm going through a battle like that now. get an attorney. its your only hope.
that's the way it is in PA too. Dealing with USAA, i picked up a 98 HX with ~20,000 miles for $11,500. Almost a year later I hit a rock in the road around a turn, they decided to total it. They also gave me the option to take out anything I wanted, and some of the stuff I didnt' get out they gave me the money for (neuspeed strut and DEI alarm system) All in all the car had 42,000 when it was wrecked and I got around $12,700 for it
