Pulled Over in Loudoun County VA, HELP
ok, tonight my friend and I (due to a complete lack of judgement) were racing on route 28 in VA, at 3AM
we got pulled over and cited for reckless driving 96mph in a 55mph
this is in Loudoun County VA and I wanted to know what your advice is. I heard that a person got cited for the same offense on a neighboring county and got a day in jail, restricted liscense and the applicable court costs.
this is pretty much the worst thing I could imagine right now, so if anyone has any magic strings or spare get out of jail cards...I could really use em....
so if it's a good lawyer or someone you know that works at the courthouse I could really use a favor
also FYI, I have a clean driving record if that matters at all....

***get a lawyer*** having a clean record is to your advantage, but realize that you're probably going to lose your license (temporarily) and get fined. you're chances of staying out of jail are pretty good.
I've got a buddy going to trial on the 28th for something similar (although worse). Sucks, but what's done is done.

i dont' think you will lose your license. I thought if it was in excess of 100mph. Maybe thats just california. Just hire an attorney.

Dude, the bottom of that article say that if you were going more than 25 over the limit that there is a high probablity of jail time. GET A LAWYER, and stay the hell out of Virginia with any car you might find yourself speeding in.

Cause if you were both in the same car and you werent driving you wouldnt have to worry. Anyways, my friend and I were going 100 in his truck, we got pulled twice for going that fast. The first time was a narc and he just said slow down, he was going 90+ though when we passed him. The second time the cop only thought we were going 80 still fast as crap. So my friend had to go to driving school for like 8 hours and his insurance never heard of it. This is NC though.
I highly doubt you will go to jail, I mean they havnt come for you yet. If you can proveitwas spontainous drag racing, that helps too.

If you were not charged with racing, don't try to spin it as spontaneous racing as suggested above. The word racing in any capacity is not going to help you.

I noticed that speeding in VA main roads and high ways are extremely bad idea esp during late hours when there are less cars. I usually see at least one or two cops sitting in the dark whenever I drive at late hours on highways and mainroads.
i got stopped on a local parkway (the bronx river) in Ny and it was about 11:30pm...cops didnt even clock me doing a certain speed...they just knew i was speeding...so to make a long story short...i got arrested spent the night in central bookings...got no tickets or anything and had to do 8 hours community service
i was actually doing about 110mph but they didnt clock it...thank god...i didnt even get points on my license or anything...talk about lucky

I asked my lawyer and he said "they can jump out of caves if they want too, who do you think the judge is gonna side with, the cop that has no lights on or the person going 96 in a 55"

well i got reckless driving i got a lawyer... im on probation for two years i had to pay a 400 fine, 10 hrs of community service, traffic saftey school for a dya, and dui victims panel ( i dont know why i had to go)

That depends if it's supervised by the court or not. For mine I just had to bring them a signed form from anyplace of my choosing saying I did 50 hours. Guess how many hours I did. If it's supervised, the court assigns where you do it, and who supervises you. That sucks.

AS an attorney who does MANY traffic cases (here in Illinois) i would STRONGLY suggest getting a lawyer! do not be put off by the FACT that it will cost you some money. DO go shopping for an attorney. talk to AT LEAST THREE!! find one that makes YOU feel comfortable! DO NOT let an attorney blow smoke up your *** telling you only good news. an ethical and good attorney will ALWAYS inform you of ALL the possibilities in your case and will NEVER make a guarantee. you will be very well served by having competent legal representation. you can IM me if you have any general uestions, but i am not a VA lawyer and have not taken a look at the VA traffic code.
