Default rebuilt tranny 3rd gear lockout?

99 civic dx with rebuilt y8 tranny

i never used this transmission before i got it rebuilt so im not sure if it was doing this before at all

but occasionally when i go into third it just wont go in to gear i have to like put it in a different gear first and then it will go in otherwise it just wont go in as hard as u try it doesnt happen all the time just occasionally

it happens when i upshift and downshift and also when the car is off its hard to get into third too

sorry its all new honda mtf got about 2 quarts in there from when i did the swap a few months ago

could it be the washers from the detent *****? or a worn out shift fork?

Does it shift into fourth correctly? The third gear shift fork and detint rod are shared by fourth. Sounds like a bad syncro or perhaps the clearances weren't set properly, either way it will most likely need to be opened up.
