Default Urgent Stolen TYPE R!! And guess who stole it?? Honda!!!!

Honda Finance is SLIMEY!!
Read on to find out why.

It is with great sadness that I saw my 2000 Phoenix Yellow
Type R #779 depart today as a result of reposession.
I made steady payments to Honda Canada Finance but recently
moved to Florida on business for an undeterminable time.
I talked to the Acura dealership on Lake St in St Catherines
and they said that there would be no problems.
When I arrived in Florida I immediately called Honda Finance
to make new payment arrangements with them.
That is where the problems arose.
In the small print on the lease agreement it says the following:
Section 12: Use of Vehicle You may not permit the use of the vehicle
under the following conditions: Section C garage a vehicle outside of Canada for
a period exceeding 30 days unless with the Lessors consent.

Here's where the bullshit starts.
I called them and sent them a payemnt.
I talked to a guy by the name of Rakeesh who immediately forwarded me over
to this other guy Yonik who deals with tracing cars that are outside of Canada.
They treated me like the car was stolen.
I told them that I called them, and had I not called them they would never even
have known that the car was in the States. I was informing them because it was
the proper thing to do.
I was trying to negotiate payment terms with them.
I sent them a western union quick collect payment and was told that it was ok
for me to have the car in the states for a certain time period and that they
were working to get me authorization to keep the car in the states.
I said that was fine, and if I had to I would switch the lease over to a purchase
assuming that I would have no problems financially with them seeing as I've bought
two integras in the last 4 years. I handed the other integra in at the end of the lease
just a couple of months ago. The car was in mint condition and only had 30 000 miles on it.

So anyway, I am getting frustrated with HCF because they are not taking my phone calls,
I call Yonik on his cel number which he gave me and then he tells me off for calling him on it. I am trying to arrange payment methods with them and getting nowhere.
They wont take a u.s. check or money order, they wont take a credit card,
they wont take a wire transfer, they wont take my money!!

This morning I awoke to two repo guys jacking the car up (and not even on a flatbed)
I asked them what they were doing and they said that they had authorization to reposess
and that the reposession was coming from Honda Canada Finance.

So I call Yonik and ask him what the **** he thinks he's doing?
I explain to him that im more than willing to make monthly payments on the car
and that I have been trying to make payment arrangements with him.
I assumed they wanted to pull the money out of a Canadian bank account, so I wired
cash to my wife's account in Canada.
He tells me that the terms are now non-negotiable and that if I want the car i have
30 days to come up with $23 000.00 which is the buy out.
We were originally talking about switching the lease to a finance agreement
and I even had Ralph at the dealership start the paperwork for me.
Apparently that is not acceptable any longer because they dont want the car in the u.s.
that was his answer. My answer to him was that in the agreement it doesnt prohibit this
expressly it says that all they have to do is give a written document saying that its ok.
They werent prepared to do that.

Here I am a guy that has bought one car through honda finance and paid it off.
Then purchased a second car (the R) put 2 years worth of payments into a lease that I would like to buy out. I made that decision 1 week after leasing the R.
I've modifiend the car because I planned on buying it out. Put 10 grand into it.
I have paid honda on time like a champ!
I let them know where I am and my intentions!
They tell me to put 2 million worth of insurance on the car and it would be ok to be
in the states, so i did at great expense i might add.
Then they send the repo guys out and pick the car up.

If you feel this is unfair please call Yonik at Honda Canada Finance
he can be reached at 416-754-6755 or on his cel at 416-402-9485

At this time I am considering this a theft because of the circumstance.
Please show your support for a fellow ITR owner and help me get my car back!!
Please call Yonik and blast him!!

Sincerely
Russell Rockefeller

You broke the rules and they took the car back.

I know it sucks, but I don't see why you're complaining.

Why did you do this? You should have kept the same payment arrangements.

If you made every effort and they misled you into thinking they would arrange a new contract, and you have it in writing.... sue.

I'm complaining because im not going to be here forever and I am more than willing to communicate and pay them but they arent taking my money!
Dude they could do this to you!!!
You could be next!@!
If for any reason say you modify your R and they don tlike it??
They can take the car back!!
Help me out!
I have a feeling that if there is enough pressure here, they will renegotiate my terms.

The R has been out of Canada for less than 60 days bearing in mind
that I have made payments and been in communication with HCF
Everything was A ok until this morning when I got surprised.

I wonder what the legality of them repossesing the car in a foreign contry is...wonder what Florida law would say on that.

Just to show being honest isn't always good...sigh...
If you really want your ITR back I think you should get yourself a lawyer. People calling in for you won't do you any good. Instead, I think it might harm your intentions.

I'm working on it but I believe that people calling in will make them respond.
If I get some support on this and you guys represent then it will make a difference!! Yonik even said to me on the phone that they have made exceptions in the past in this circumstance because the person squeaked.

Did you TELL them you were going to floriday AFTER you were already there or BEFORE you went? With this type of stuff I think the general rule is to ask for permission instead of apologizing after already acting.

Not much, if he tried to stop them they could have used force. They have a legal order to repo it, so they repo it. Florida law wont stop that. However, HCF might not be able to legally request a repo without first alerting some sort of us agency? no clue on that.

I talked to the dealership beforehand and asked if I would have any problems
and they responded with none whatsoever, just talk to HCF when you get down there. That was about 3 months before i actually moved!

Please represent!! I mean whats next?
They find out you put an intake on so they get the car back?
My gut feeling is they know ive modded this car and that it is valuable more than the buy out and they are juicing me through their agreement.

You could have just kept on paying your payments, Honda/Acura Canada didnt have to know your car was out of Canada.

Or you said that your wife has a bank acct in Canada. Is she still there?
If so, then u should have let her pay for the car.

If they have misled you - from the dealership to HCF about what you could do - then get an attorney and have him get on the phone and write some letters...

i would call ,b ut i know how i am . i would go off on the guy and tell him and all his mangers there off. i dotn really know if that woul dbe helping you out.

i wish i knew what to tell you besides whats been stated

get a lawyer!

i dont know much about the law, i do know i would make sure i got these guys fired one way or the other.

my recomendation would be to call the financa company and speak to the boss of the boss of the boss and very calmly and professionally explain to him what happened. explain you have been a honda customer for years, give him a background of you and your purchases or leases. tell him you would wish to continue to do buisiness with them. plea with him to help you, try to make him fell sorry for you. tell him you were just trying to do things the right way. that might help you get somehwere, but only a lawyer would be able to tell you how you can lgegally get this resolved.

good luck, i hope you get your car back.

get a lawyer man, NOW.. americans calling Honda Canada Finance doesn't mean anything.. you're just going to irritate them further.. BTW - Honda dealers, although they work with Honda Finance for purchases, really don't work that closely together after the sale is made.. you should've contacted HCF from the beginning..

they already have your car, now you need to work on getting it back..

There wasn't a need to tell them you 'moved'.... if you had someone in CA to make your payment (i.e., wife) then there's no reason to tell them you were gone for a while. It IS in your lease contract, you signed it, and so they have a very good case against you. Now, as far as getting the car back, I have absolutely no idea. Us calling HCF will not help. The US people on here calling HFCA won't help either. Call a lawyer and get some advice, fast. Sorry to hear about your strange situation and loss.
