Awnsered my own question i called the referee. Any swap weather its offered in that type of car or not.. ex ,lx, dx are all required to be bar'd in the state of California ...
If it's "functionally the same" then no you aren't required to BAR it. However, I'm not sure if those engines are functionally the same or not. I don't even think a regular smog technician would notice the difference.
He could do that but it's not like other states. They'll scan it the vin bar code and it's going to give the technician a detailed check list. Their machines have a pretty detailed data base. They WILL look at the block stamp. If ALL of the Y8 emission equipment isn't there, hooked up and functioning properly they send you to a referee station.

I am on the same boat. I have a 91 civic DX with a d16a6 and went to a smog shop and they told me I needed it to be bard because in the computer it says I should have a 1.5 not 1.6 even tho the motor came from a higher model.
