I hate to say it but, probably... All I can say is don't let them do that, they will probably offer you some insanely low amount of cash and they will keep the car. Take what you can get and still keep the car. Maybe not, but they definitely won't give you more than blue book. I don't care if you have $50,000 in the car. One word: junkyard... Buy the parts and fix it yourself.

Just to illustrate my point, I had a '91 Mustang with 20k miles and about $10,000 just in the motor, tranny, and rear end. Dumba@# locked it down in front of me on a two lane road in the rain doing 60 and I took out a phone pole. Cosmetically not too bad but hit the rear passenger side on the wheel and shoved the entire rear assembly over about 8". Looked like a dirt track car, lol. Ended up being his fault but insurance wanted to total it cause it was over $8,000 in damages on a car with blue book of about $12,000. They were offering to buy me a brand new one and I had to pretty much raise immortal hell and take a loss to keep it, just because of the mods I had done were worth as much as the car. Obviously, they wouldn't let me get my parts back if they took the car.

you can make the insurance company pay you just need to go after them if the other person hit you then you gut nothing to worry about ,, u cant just take it to the autobody shop and have them fight the insurance company ?

Get three high estimates and make them cut the check without totaling it unless that's what you want which I know you don't.

So I decided to hire an attorney I got three high estimates one was for 2200 the other was for 2300 and the highest one was for 2800 the car runs straight cosmetically it just needs the front fender driver side also needs the front turn signal and the front filler The car is in good condition I still dont want to give it up and I hope they don't want to give me peanuts for my car fixed! I just keep getting conflicting stories from different people in the Ins. Business I can't post pics I have an iPhone sucks!

Just keep telling them you WILL NOT total it no matter what. They can't take your car from you. All they can do is not give you all the money you want. They may give you all of it or not. Just see what happens. The estimates you got are probably for NEW parts, so at least you can probably fix it with junkyard parts for a lot cheaper if they crap out on you...

I may be able to shed some light.I am a licenced Auto appariser and have come across this many times.Depending on what the value is of the vehicle they may want to total the vehicle and will give you what book value. In MA, appraisers use NADA Value. If the insurance totals the vehicle and pays you the value of it and they own the car. But there is some good news, Older cars have little salvage value at a salvage yard , so some insurance companys offer a "buy back" . So if the car is say worth $2,000 and the company says for 300. dollars you can keep the car , they will give you a check for $1700.00 and you can keep it but will have a salvage title.
Its cost a insurance company more to process a old car total because they dont get as much if the car was newer and the yard will give them more for it.
Just ask your company and see if they offer the buy back.
Good luck..

Ask them to cut you a check and go to a junkyard get the parts you need and save the rest of the bread for the future
