got busted for a modified smog device (intake), but i got an idea! check it out.

I was pulling into the driveway of an In N Out in Fullerton, CA--a popular racer hangout in the area. As i rolled in i noticed a gang of cops at the entrance. He stopped me and asked me where my front plate was, because it didn't have it on. Then he told me to park at a certain spot. I thought to my self, "Oh well, a fix it for my front plate. Not a big deal $10 and its over." Then he asks me what i did to my engine i told him intake and exhaust. Then he makes me open my hood and he tells me I have an illegal intake (lucky I had DC headers). It was a no-brand cheap-*** intake. I told him that I took it to get a smog check and they said it was Ok. He has the nerve to say I got it done illegally, which I didn't. He also told me that any kind of open intake is illegal in the state of California. He told me the ticket will cost me $250 and I would have to go to a smog referee. I know he got me on the intake cause it has no carb #, but what if i buy an Aem intake which does have the Carb# and make it look used and bring it before the judge. I'll bring it before the judge and show him the papers that it is Carb legal and tell him this is what i had under my hood when I got the ticket. My court date is approx. a month from the date of my ticket. I highly doubt the cop will remember what my intake looked like and he probably looked in the hoods of a gang of cars. I'd rather pay $130 for an Aem intake and fight it in court rather than paying $250. Do you guys think my plan will work?
I have Zero experience with Cali. smog ****'s, but hell, it couldn't hurt. You're furthermore better off with a good quality intake anyhow IMO. Perhaps the Judge will throw the case out when he sees that you complied- at least that's the way it is here in NC...

It happened to me be4 and the cop that gave it to me said it was not correctible and it was going to cost a couple hundred dollars. It was BS! I got it signed off. I went to court to fight it and the only thing that the judge asked was, if I got it taking care of?. I said yes and I showed him the signed ticket. All I ended paying was 10bux.
BUT, this happened a couple of years ago and the 10bux rule has changed. Now, u automatically pay the fine of the correctible violation.

You cant do that. You are REQUIRED to take your car to the smog ref....and you cant drive your car on california roads until you do. So make your appointment NOW. You cannot get a cop to "sign off" on it...its not a kix it ticket.
(this happned to me in both my civic AND my eclipse so i know all about this ticket)You should also know if a cop catchs you driving on california roads before you have taken care of the ticket they *can* pull you over and tow your car and impound it...and most likely will. Ive had it happened to a friend down here in san diego where i live.
But what you can do is put back on your stock intake, go get it done at the ref which is $48 (i believe), then go into court with the ref papers and they will dismiss it. (so you dont have to pay the $250).
If you dont want to go through the trouble of going to the ref you can just pay the fine and call it a day. This is what i did for my turbo civic...as i was too lazy to pull off the turbo and take it to the ref.
You AEM idea has a good chance of working though...just say you never put on the CARB sticker so the cop didnt see it. You might get away with it.

a buddy of mines just borrowed his friends AEM carb paper and presented in front of the judge..judge said fine and threw the entire case out.

People who live out in California should sell their car and give up life. J/K All the harassment would annoy the hell out of me, enough to never put another part on my car again.

cali sucks PERIOD
i remeber back in 97 when me and my boy came back to visit family in cali we got busted for have a buddy club front the cop said that our head lights wasnt stock. LOL and it was. hahaha i thought the cops in cali should be very experience with honda cars

Kali peeps have some of the nices rides, but have such a strick emission law. I don't see why some of them waste there hard earn money on performance part and mods...if most of the time the law harasses them.

but if i go to the referee i heard that they give people hell. should i put my stock exhaust back on too. it's a 5zigen catback. also the cop said i had to pay the $250. he said it wasn't a fix it. I jes got married and have a baby on the way and i really don't have that money laying around. is there any way of getting around that fine or paying a lesser fine?
best bet is this, get the carb paper and contest the ticket. if u win, and u probably will win since the intake should be legal, the ticket will be thrown out. the cop was talking out of his ***. i got a ticket for license plate before and the dumbass rookie said its not correctable. so i come in to ask about it at his station, and one of his fellow buddies says hes an idiot and it is correctable. so that cop just signed it right then and there without looking at my car. pretty cool guy if u ask me. just go in and plead not guilty, and play it by ear. come back to H-T if u have any more questions, we can be a good help at times.

i think it will, because its the laws damn fault will saying eerything is illegal when parts companies work hard to get carb stickers and ok'd

thanx for all the help fellaz. by the way the cop was such an ******* that he took his pen and wrote "none, no sign off" on the back of the ticket where the sign off would go!
i'd also check SEMA for more info on this ****. SEMA practically hooked us up and now exhaust tickets arent as easy to give any more. an intake is not enough to **** with ur emissions that much. im telling u, if u fight, that cop will probably not show.

in the future to avoid costly fines just get CARB approved mods..avoid *no name* things that attract too much attention to legal or illegal upgrades..also, the US dept of transportation has ruled that Calif. smog laws might be illegal cuz they circumvent federal guidelines on pollutants so in the future things might slighten up..but dont hold ur breath..police harrassment *they wont call it that* will continue in efforts to curb the streetracing scene

since yours is not correctable, just put everything to stock when you go to the ref. cops are getting really strict on hondas lately, coz of that stupid movie F & the F. also there are a lot of stupid ricers here in cali thinking they're fast because their civics have mufflers.

If a cop searches your car, you have a right to tell them to stop anytime because they do not have a search warrant. It's illegal if the cop doesn't stop. You have a right to say no.
I stopped going to In-N-Out a long time ago. I used to go to all the gatherings 3 times a week over there, but there are too many ricers there that kill it for everyone.
