Slight hard shift when cold and noise in first gear, Should I still be concerned?

Well I checked the fluid, it was good. Did it after it was warmed up. I took it to the shop that rebuilt it in July of 2010. Thats why it has the same trans still. They check it out and said its normal for it to hard shift a little with as cold as it has been lately, which is really when i started noticing that when we finally started getting "Cold weather". Said its due to the thickness of the fluid. He addressed the "Curly 3 stooges sound" when it startes off in first gear. He said normal for the CL or "those type" as he stated. No codes or anything, so looks like my car is fine, just jitters of a trans issue since I just got it about a month ago.
